- Failure to investigate allegations of abuse: “Z2 (Physician) failed to notified the facility of allegation of a staff hitting R2. The [MEDICAL CONDITION] Summary Report dated 04/09/11 stated “Patient is very anxious. Sleep and appetite O.K. Was hit by staff recently. Patient was wandering around unit, but staff notes no other issues, beside anxiety.” The Nurses Notes dated 02/28/11 denoted there was no documentation of the allegation or investigation of staff hitting resident. Upon prompting E3 (Nurse) and E2 to read the [MEDICAL CONDITION] summary report. Surveyor asked did you know resident was hit by staff. E2 (Nurse) on 05/04/11 at 3:00 pm in the nurse station stated,” No, I did not know about this. This is the first time, I seen this. E3 (Director of Nurse) stated,” No, It came to my attention after I got the copy.”
- Failure to provide consistent supervision to residents at risk of falls: “The Incident/Accident Report dated 12/25/10 at 7:00 pm denoted ” writer approached by Certified Nurse Aide stating that above resident fell on the floor and hit her head on the edge of the wall. Blood noted oozing from the back of her head. First aid administered.” The Nurses Notes dated 12/25/10 denoted resident was send to Z1 hospital for possible sutures. 12/25/10 at 11:00pm -7:00am – Returned from Z1 on stretcher accompanied by 2 paramedical with 4 staples to back of head. E3 ( Nurse) on 05/03/11 in the social services room stated,” We did not reassessed or revised the care plan after the fall.”
- Failure to implement interventions to prevent fall related injuries: “Facility’s Incident/Accident log shows R1 was found on the floor by staff on 12/11/11, with his head against the wall and a “raised bump” on the back of his head. R1 was sent to the hospital for evaluation and, per nursing notes dated 12/12/11, returned to the facility with a cervical collar in place. Quarterly Fall Risk assessments dated 4/28/11 through 9/28/11 shows R1 at high risk for falls. Care plan dated 4/13/11 through 10/13/11 provides for generic interventions to address R1’s fall risk. On 12/13/11, following the fall, implementations for use of bed and chair alarm and use of self-release belt when in wheel chair were added. During the initial tour of the facility on 3/29/12 at approximately 10:00am, R1 was observed in bed lying in a supine position with the bed sheet pulled over his head. E4 proceeded to pull the sheet down from R1’s face and engage R1 in conversation. R1 remained with eyes closed, not acknowledging E4’s presence. R1’s bed was at regular height with no bed alarm in place. A wheelchair next to the bed which E4 said belongs to R1 did not have a chair alarm attached.”
