Many families place their loved one in a nursing facility because they require the highest level of care and assistance to ensure their health and well-being. Unfortunately, many nursing facilities in Illinois lack proper staffing, have overcrowded conditions or are run by teams of nurses that lack proper training to follow established nursing home protocols. Unfortunately, the Wauconda elder abuse attorneys at Rosenfeld Injury Lawyers have handled many cases where residents have been seriously injured or suffered a wrongful death due to the negligence of caregivers.
Often times, residents lack the ability to walk, feed or bathe themselves without assistance. In some incidences, if the staff member does not assist the resident during meal times, it is easy for the resident to choke while attempting to chew or swallow. The resident is alone, no one is around to help them or call for additional assistance should they begin to choke.Wauconda Healthcare and Rehabilitation Center

Currently, Wauconda Healthcare and Rehabilitation Center maintains an overall five out of five available star rating in the national star rating summary comparative analysis system. This includes five out of five stars for quality measures and staffing issues and four out of five stars for health inspections. However, our Wauconda Illinois nursing home neglect attorneys have found numerous safety concerns involving this facility that include:
- Failure to Provide Residents an Environment Free of Accident Hazards and Risks and Provide Adequate Supervision to Prevent Avoidable Accidents
In a summary statement of deficiencies dated 08/13/2015, a notation was made by a state investigator during an annual licensure and certification survey concerning the facility's failure to "ensure a safe transfer [of the resident and a failure] to monitor a resident with aspiration precautions while eating in their room.” The deficient practice by the nursing staff at Wauconda Healthcare and Rehabilitation Center affected one resident “reviewed for safety and supervision during dining.”
The state investigator noted the resident’s 12:35 PM 08/12/2015 Meal Ticket that was on the resident’s “tray in his room that shows aspiration precautions.” It was noted at 8:56 AM, “the door was closed and [the resident] was in his room eating breakfast. There was no staff in the room with him.” A Registered Nurse at that time stated that the resident “was a slow eater and that he has problems swallowing and chewing.” On 08/12/2015 at 12:35 PM, the door was [again] closed and [the resident] was in his room eating lunch.”
During the observation, it was noted that the “head of the bed was at 30 degrees.” The resident “was having a difficult time eating his lunch [...and] could not reach his plate [...and] asked for help. [The] surveyor went to the doorway and notified [the Registered Nurse/Restorative Nurse who] put the head of his bed up right away, saying your head should be up higher.” At that time, the Certified Nursing Assistant (CNA) “came in to help” the Registered Nurse. The resident “then was sitting up 90 degrees in the bed and could reach his food better.” However, the surveyor noted that both the Registered Nurse and the Certified Nursing Assistant “left the room and no staff were in the room while [the resident] continue to eat his lunch.” The resident “started coughing twice.”
At 9:05 AM on 08/13/2015, in an interview with the Director of Nursing facility, it was revealed that “if anybody is eating in their room, then staff/CNA should be in the room with them the entire time they are eating.”
