Sordid Discoveries Regarding Patient Health Care at Waterfront Terrace

The surveys conducted by the Illinois Department of Health and other private health inspection firms discovered different episodes of poor patient care and abuse at the Waterfront Terrace which could be interpreted as nursing home negligence. The nursing home attorneys of Rosenfeld Injury Lawyers LLC reviewed the findings of ProPublica and following episodes:

  • Failure to assess a resident after a fall:  “This failure resulted in R4 attempting to stand up from a wheelchair and falling to the floor at 8:30pm on 9/28/10, R4 was placed back in the wheelchair and sat in the hallway. R4 was eventually placed in the bed and at 2:00am 9/29/10 R4 complained of pain and was assessed to have pain at the right hip area and loss of range of motion of the right hip. R4 was transferred to the hospital for evaluation and admitted and treated for [DIAGNOSES REDACTED]. According to the hospital records dated 9/29/10 radiology report findings include an oblique [MEDICAL CONDITION] femur with sperolateral displacement. 10/1/10 R4 underwent the partial right hip replacement surgery.”
  • Failure to provide adequate monitoring of residents: “On 10/18/10 at 5:10am, R1 was found in bed bleeding from left shunt/fistula and laying in a puddle of blood. R1 was transferred to a local hospital where R1 was later intubated. R1 expired in the emergency room of this local hospital at 7:27am. Review of the Medical Examiner’s Autopsy report indicates that “R1’s AV fistula showed a thrombus (blood clot) 1.5cm in diameter with 0.3 cm erosion of the intima” (inside). R1’s death is ascribed to “Hemorrhage due to erosion of AV fistula. Review of [MEDICAL TREATMENT] data (a part of R1’s care plan) from Midwest kidney center under section A-3 indicates that a blood clot can be detected by checking the [MEDICAL TREATMENT] access at least twice daily and listen for certain sounds (called the thrill and bruit). The last evidence that was provided to surveyor indicated that the facility staff had not checked/monitored R1’s AV fistula site since 04/24/09.”
  • Failure to notify physician of abnormal blood sugar levels: “Record review of nurse’s notes dated October 29th and 30th at 11 AM blood glucometer results not relayed to doctor. Record review of medication daily charting for November 2nd 2011 denotes glucometer result of 371, November 3rd glucometer results at 6 AM, 391 and on November 4th at 6 AM, glucometer results 300. Record review of medication daily charting for November 6th at 4:00 PM, denotes glucometer result of 376 and at 9:00 PM glucometer result of 324. Record review of nurse’s notes do not have any documentation that doctor was notified of blood sugar results from November 1st thru November 7th. Interview with Z1 (Medical Doctor) on 12-16-11 at 2:00 PM, states he should have been notified when R1′ blood sugar was at 350 and above. Z1 states that if had been notified that R1’s blood sugar was above 350 he would have sent resident out to the hospital.”
  • Failure to ensure residents are free from mistreatment and neglect: “At approximately 3:20 pm, R9 was again observed in the dining room sitting in her geriatric chair. R9 called surveyor and stated that she has an urgent need to go to the toilet, has told this to staff, and no one has taken her. R9 identified E7 (Activity Aid) as the staff she spoke to. E7 stated R9 did tell her about 15 minutes ago that she needed to go to the toilet. E7 said she immediately told E8 (Nurse)
    about R9’s needs. E8 entered the dining room at this time, sat down, and E7 left the dining room. E8 stated that she was aware that R9 needed to be toileted but she was busy monitoring residents in the dining room and was not able to leave the area to locate the nurses’ aid. E8 went on to say that there is only one nurses’ aid on the unit at the time who is busy assisting other residents. R9 is a [AGE] year old resident who has had 9 falls over the past 4 months. 5 of these falls were related to R9 attempting to get to the toilet on her own.”
  • Failure to identify residents who are frequent fallers and address fall prevention: “R2 experienced 2 unwitnessed falls on the day of admission; R9 had 9 falls in past 3 months; R14 had 1 fall on day of admission and 6 subsequent falls; R18 was found at the bottom of the stairwell 2 days after admission. The facility also failed to investigate and assess these residents for the root cause for falls and update fall prevention interventions measures to protect them from further falls. Furthermore, the facility does not have a fall monitoring program in place.”
