Concerning Findings Regarding Patient Care at Warren Barr Pavilion

Data from nursing home surveys conducted by the Illinois Department of Health and other private agencies, showed that there have been numerous episodes of poor patient care at Warren Barr Pavilion which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to provide care to maintain the highest well being of residents:  “R19’s care plan does not have instructions or direction for the care and monitoring of R19’s renal access. The care dated 5/21/2011 address R19’s care and services for [MEDICAL TREATMENT]. It noted R19’s AV fistula and no services listed to be implemented by [MEDICAL TREATMENT] discipline(s). R19’s record does not show R19 with a AV fistula but documents a vascular cath in left internal jugular vein for a renal access. R19’s care plan is not addressing R19’s current renal access site.”
  • Failure to provide services to promote healing of bed sores: “R3 has a stage IV sacral ulcer and was observed on 5/23/11 to 5/26/11 (between 8:55am and 1:30pm). During the observations of R3 for four consecutive days, were noted to be in the same position for long periods of time, greater than two hours. R3 was noted not having position alignment, while all day in bed. Also a turning schedule not posted. On 5/26/2011 the restorative Nurse provided list of residents participating in the program, two hours after requested. R3 was not on the list.”
  • Failure to have an appropriate monitoring system for residents: “This failure consisted of: -not fixing an inoperable call light system in a timely manner. The call light system on the 6th has been inoperable since 2/2011. -not assessing 6th floor residents for an appropriate replacement monitoring system to meet their individual needs. -putting in place a hall monitoring system for visual control of 6th floor resident rooms. These failures resulted in an Immediate Jeopardy for R1, R8, R9, R10, R21, R32, R33, R34, R35, R36, R37, R38, R39, R40, R41, R42, R43, R44, R45, R46, R47 and R48.”
  • Failure to monitor a resident with a known significant change in condition: “On 10-25-09, at 7:45am, because of [MEDICAL CONDITION], a physician order [REDACTED].” 400 cc of dark red urine.” At 8:15am, the urinary output is described as “600 cc of bloody urine, no clots.” At 8:45am, E5 informed Z1 (Attending Physician) of the urinary status. Orders were given to E5 which included to irrigate with 50 cc of normal saline and if hematuria persist to notify the physician. Further review of the nurses notes dated 10-25-09 indicates that between 8:45am, and 1:30pm, R1 was not being monitored. There is no documentation to show evidence that R1 with a known significant change in condition, was monitored. Interview with E6 on 11-17-09 at 9:30am, stated that E5 told her that she irrigated the catheter of R1 at 8:45am and the need to monitor. E6 further stated that she monitored the resident about “every 30 minutes or so.” when asked about the documentation to support the statement, E6 stated that” there was not an order to monitor, so I did not chart.” Nurses notes indicate that finally at 1:30pm, E6 documents that “700 cc of bloody urine output with bright red color.” When asked about checking vital signs, E6 stated that “I only checked the vital signs once after receiving the order at 1:40pm to send R1 out to the hospital.”
  • Failure to thoroughly investigate allegations of abuse: “R2 put in a Concern Referral Form dated 11/23/11, complaining that a few CNAs were being rough with her while transferring. On 1/28/12, R2 again complained about rough treatment by staff which left her with a bruise to her right leg. E17 was identified by the resident and an Incident report (dated, 1/28/2012) was initiated. The facility did not present an abuse investigation. On 3/18/2012, R2 was observed with a swollen and red area on her left wrist. An X-ray was done. The X-ray revealed, “soft tissue swelling with some [MEDICAL CONDITION] arthritic changes” R2 identified E20 as pulling her by her left wrist. R2 was interviewed, 3/19/2012 at 3:15PM. “I told everybody including the Administrator.” The facility failed to produce an abuse investigation any of the incidents.”
