Attorneys for Patients Mistreated at Warren Barr Living and Rehabilitation Center

Warren Barr Living and Rehabilitation Center – Gold Coast In its early stage of development, any bedsore (pressure sores; pressure ulcer; decubitus ulcer) is completely preventable. However, if the bedsore is left untreated or not properly treated, it can easily develop a crater and expose muscles, tendons and bones in an open wound. In fact, the elder abuse attorneys at Rosenfeld Injury Lawyers have represented many nursing home victims who have suffered life-threatening facility-acquired bedsores that were completely avoidable.

Bedsores develop when residents in nursing facilities lie motionless for extended periods of time. The pressure on certain body parts restricts blood flow and nutrients causing skin and underlying tissue to die. A bedsore can appear in as quickly as two hours if the resident is not repositioned or turned by the nursing staff to alleviate the pressure.

Because bedsores develop through degenerative means and cause permanent tissue damage, there is often a strong possibility that the ulcerated wound can claim the life of the victim without immediate treatment. Common areas of bedsores include the lower back, hips, knees, elbows, shoulders, back of the head and heels.

  • Failure to Provide Adequate Services to Prevent the Development of a New Bedsore or Allow an Existing Bedsore to Heal

In a summary statement of deficiencies dated 02/11/2016, a state surveyor made a notation during an annual licensure and certification survey concerning the facility's failure to "follow their wound prevention protocol and obtain a dietary consult for [one resident at the facility] reviewed for pressure sore interventions.” The state investigator also noted that the facility failed “to follow their wound prevention protocol and ensure that low air loss mattress was utilized as recommended by the manufacturer [for three residents at the facility] reviewed for pressure relieving interventions.”

In one incident, a resident at the facility who was “paralyzed below the waist and unable to turned/repositioned without assistance” appeared on 07/01/2015 with a “new skin breakdown [on the] left buttocks. The pressure ulcer Stage II [measured] 2.5 centimeters by 2.0 centimeters by 0.1 centimeters.” An additional Stage II pressure ulcer was found on the resident’s “right buttocks [measuring] 2.6 centimeters by 2.2 centimeters by 0.1 centimeters.” Eight days later on 07/09/2015 appeared with “an unstageable pressure ulcer” to their sacrum measuring “3.0 centimeters by 6.2 centimeters by 0.1 centimeters. A nutritional assessment was not conducted on [the resident until over a month later] on 08/12/2015.

In a separate summary statement of deficiencies dated 03/16/2016, a state investigator noted that the facility also failed to “consistently and accurately assess, and monitor a pressure ulcer after readmission to the facility for [a resident] reviewed for pressure ulcer evaluation and treatment.” This incident involved a 04/22/2015 readmission to the facility of a resident “after right knee revision surgery.” At that time, the resident “also had a right heel pressure ulcer.”

The state investigator interviewed the facility’s Nurse Practitioner/Wound Care Specialist on 03/16/2016 who stated that “he does not manage surgical incisions unless the surgeon requests him to [...and] denied being notified or managing [the resident’s] right heel pressure ulcer.”

The surveyor noted that the attending physician’s 05/18/2015 progress notes revealed that the resident’s posterior right heel wound now had “drainage serous fluid on a bandage. Slough covering 50% [of the resident’s] wound. No foul odor, no tenderness to palpation. No surrounding redness or swelling, though the borders of the wound were white, indicating maceration [softening of tissue after the skin’s death].”

Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own. Ethan Armstrong, Google User
