Concerning Findings Regarding Patient Care at Tri-State Nursing & Rehab Center

A survey conducted by the Illinois State Department of Health and other private agencies discovered numerous cases of poor patient supervision, inadequate care equipment and abuse which can be construed as nursing home negligence. On reviewing the surveys of ProPublica, the nursing home attorneys at Rosenfeld Injury Lawyers LLC discovered the following episodes which can be construed as negligence:

  • Failure to prevent skin breakdown: “During repositioning of R7 surveyor noted an uncovered area of skin breakdown, approximately 1.5×1.5cm in dimension. Surrounding this lesion was a large area of intact, red, excoriated skin. Neither E24 nor E25 had any previous knowledge of this lesion. E25 applied Aloe based cream to the site and completed R7’s hygiene care. During wound treatment observation at approximately 3pm, E11, Treatment Nurse, completed wound care to both feet. During repositioning of R7, surveyor observed a lesion on the Left inner knee. E11 said she was not aware of the existence of this wound which she described as an unstagable wound with measurements of 1.5×1.0 centimeters (cm). Surveyor then prompted E11 to check R7’s skin at the area of the left lateral trunk. R7 was repositioned to reveal the area of skin breakdown noted earlier during hygiene care. Regarding this wound E11 stated that she was not aware of this new development. When asked by surveyor whether E24 or E25 reported it, E11 said “no”. E11 stated that wound appear to be the result of friction rub against bed of chair and obtained measurements which were 1.2×1.7 cm.”
  • Failure to manage and treat pressure sores: “R17 is a [AGE] year old resident with multiple [DIAGNOSES REDACTED]. The Care Plan states R17 is at risk for skin breakdown and requires the use of pressure reduction cushion when in chair, turning and repositioning every two hours and as needed and to receive incontinent care after each incontinent episode. R17 is incontinent of both bladder and bowel. On 7/13/10 at approximately 12:30pm, R17 was observed by surveyor in a geriatric chair in the lunch room. R17 was not eating and had a sad look on his face. When approached by surveyor regarding not eating, R17 told surveyor, speaking in Spanish, that he was not able to eat because he has been sitting in the chair and in the same position since earlier in the day, was very uncomfortable; his bottom is wet and burning. Surveyor observed the mechanical lift body sling under R17. E27, Nurse, came over to R17 at that time and immediately offered him a substitute. Surveyor explained to E27 that he, R17, was complaining about being uncomfortable and in pain. E27 then told E8, Certified Nurses Aide (CNA) to transfer R17 back to bed and provide incontinent care. E8 was assisted by E9, CNA, with this transfer. E9 told surveyor that R17 requires total assist with transfer. A mechanical lift was used for the transfer. R17’s diaper was wet. When removed, surveyor noted wound on the right upper posterior thigh to be exposed, not covered by a dressing, with a bright red tinge of blood on the diaper. The [MEDICATION NAME] dressing was near the wound site, crumpled and hard, dry and brown in color. R17’s Treatment flow sheet shows that the dressing was last changed three (3) days prior, (7/10/10). When R17 was transferred onto the bed with the mechanical lift, the sling was not removed from under him. E8 put two incontinent pads under R17 and left him lying on the body sling. The chair on which R17 had been sitting did not have a pressure relieving cushion on it. E9, CNA, told surveyor that there is not a pressure relieving cushion built into the chair.”
  • Failure to keep residents free from medication errors: “On 06/27/11 at 12:00pm in nurse station stated,” Medical doctor order [MEDICATION NAME] 20mg at 5:00 pm. It was given at 8:30am. It was just a medication error.” On 06/27/11 at 8:30am, E3 did not administer 3 medications to R17. The physician order [REDACTED]. E3 on 06/27/11 at 12:05pm in nurse station said “[MEDICATION NAME] is once a day on Monday at 8:00am. I didn’t give it, it’s not available. I didn’t give the [MEDICAL CONDITION], it’s given at 6:00am. I’ve never given it.”
  • Failure to prevent avoidable falls: “Based on interview and record review the facility failed to provide supervision and prevent an avoidable fall incident for 1 sampled resident identified to be high risk for falls R1. R1 has a documented
    history of subarachnoid hemorrhage, and was on anti-coagulant therapy. Subsequently R1 fell from the bed, hit her head and was admitted to the hospital 1 day later with a [DIAGNOSES REDACTED].”
