According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous episodes of poor patient care at Terraces at the Clare which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to properly screen new employees:  “During the onsite survey conducted on 7/19/2011 the facility abuse policy in part states: “Prior Employment Verification -minimum of 2 written/verbal verifications” The following CNA’s personnel records were checked with E13 (HR-Human Resources). All 10 of the CNA’s hired since the last annual survey did not contain pre-screening employment verification. E14 (Human Resource Assistant) stated on 7/19/11, “I did fax the screenings over to jobs, I did not get a response, and I just forgot to redo them.”
  • Failure to provide preventative care for pressure sores: “R2 and R8 were observed on 7/19/11 with E2 (director of nursing) seated in their room in chairs. A body check of both residents showed Stage I pressure sores to the buttocks area. R2 and R8 did not have any pressure relieving or protective devices in the chairs they were sitting on. E2 (director of nursing) stated,” They are supposed to have preventive cushions in their chairs.”
  • Failure to follow isolation protocol: “Certified Nurse Aide (E15) was observed entering R1’s room without washing hands prior to donning the gown and gloves. E15 stated,” I do not have to put on anything; R6 is not in isolation.” E2 (director of nursing) was informed and stated,” R6 is in isolation [MEDICAL CONDITION] of blood and urine.” Z1 (R6’s physician) stated on 7/19/2011, “R6 is supposed to be in contact isolation. R6 [MEDICAL CONDITION] in urine and has had a kidney transplant.” Z2 (family member) was observed on 7/19/11 in room without gown and gloves on. Z2 stated,” no one told me about isolation. I make his bed and help with needs. I did not know.”
