According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous episodes of poor patient care at St. Joseph’s Home for the Elderly which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to implement appropriate infection control procedures: “On 12/6/11 at 10:00 am, R1 was in R1’s room. There was a sign attached to the door of R1’s room, indicating that visitors were to “see the nurse prior to entering the room”. E5 (Registered Nurse) stated that R1 was on isolation precautions for Shingles. There was no isolation cart set up for visitors and staff entering R1’s room. R5 was in R1’s room visiting. R5 was not wearing gloves while in the room. E2 (Director of Nurses) was in the hallway near the room during this time. When R5 exited the room, E2 did not inform R5 of hand washing or the usage of protective equipment.”
  • Failure to immediately report allegations of abuse: “On 10/18/10, at approximately 6:50 A.M., R8 and E3 (Registered Nurse) were at the 2nd floor nurses station. No other staff were present at the nurses station. There was a loud commotion. E4 looked out through the dining room window to see what was happening. E4 saw E3 pulling the nurse care gloves off of R8’s hands. R8 was resisting. After R8 took the gloves off of R8s hands, she put them back in the
    cardboard box. E3 then hit R8 on the side of the head with the box. E3 and R8 continued yelling at each other. E3 then walked away and gave R8 the middle finger gesture. According to the information from facility documentation, E4 did not report this incident until 10/25/10, seven (7) days after the incident. E4 was interviewed on 11/24/10, at 9:20 A.M. in a facility office. E4 described incident, with R8 and E4, as described above. She did not report the incident immediately because she was afraid of retaliation, from E4. E4 stated she was aware that incidents are to be reported immediately. After the incident was reported the facility initiated its abuse prevention policy. R8 was examined by a physician and did not show evidence of injury. The facility conducted an investigation. E3 was suspended immediately until the investigation was completed. The facility concluded that a staff to resident abuse took place. E3 was terminated.”
