Cases of Patient Care Negligence at The St. Joseph Hospital
According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous episodes of poor patient care and sexual abuse at St. Joseph Hospital which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:
- Failure to investigate and report allegations of sexual abuse: “According to the computerize incident report, R8 on 8/01/2011, reported that while E22 (certified nurse aide) was caring for her, E22 was staring at her crotch, bent down invading her personal space and stated “do you want to have sex?” On 5/31/2012 at 10am, E2 discussed the investigation of the abuse allegation while E1 was present.According to E2, she conducted the investigation and it was initiated on 8/02/2011, after being informed by the night nurse. E2 said she talked with R8 and R8 reported incident happened on another unit prior to admission to the subacute unit. E22’s personnel record was reviewed. There was no documentation in it regarding E22’s conduct toward R8. E22 was reassigned from R8’s care. The survey team asked E2 for the written investigation. E2 said they were just personal notes. E2 presented written statements to the survey team. The investigation presented by E2 does not indicate that the allegation was reported to any other entity including but not limited to E1 (administrator) or the state agency.”
- Failure to address needs of residents with central catheters: “On 5/29/12 during the initial tour of north wing of the unit, E6 (registered nurse) stated, “R1 is here due to left knee septic arthritis …has a knee immobilizer and has a PICC (peripherally inserted central catheter) and is on antibiotics. ” On 5/29/12 at 4:30pm, R1 was seated in a wheelchair watching television in her room. R1’s feet were resting on the floor. There were no leg rests noted on the wheelchair or in R1’s room. R1’s right leg was noted to be swollen, not bandaged and the skin was tight and shiny. The current scheduled medications sheet indicates “please keep legs elevated whenever she is sitting on wheelchair, keep right leg wrapped with elastic bandage, from the foot all the way up to her thigh every morning.”
- Failure to provide comfort measures as indicated in a resident’s care plan : “The care plan for R2 had comfort measures and [MEDICAL CONDITION] management that included interventions of but not limited to, repositioning every two hours as tolerated and providing music. On 5/29/2012 at 1:00pm, 1:30pm, 1:48pm, 1:59pm, 2:10pm, 2:55pm, 3:30pm, 4:15pm and 4:38pm, R2 was alone in the room without environmental stimulation. No television or radio was playing at the time of these observations. During these observations, R8 was not observed to be able to reposition herself and remained laying on her back while in bed.”
- Failure to thoroughly cook potentially hazardous food: “In the cook’s refrigerator, 10 flat sheet pans with chicken items. According to E23 (cook), these sheet pans of chicken were partially cooked. The facility’s cooling temperature logs dated for 5/27/2012 and 5/29/2012 both indicate the chicken breasts were cooked to a temperature of 143 degree F (Fahrenheit) on 5/27/2012 and 148 degree F on 5/29/2012. According to the recipe for the grilled chicken breast, the chicken should be cooked to an internal temperature of 164 degree F.”
