Worrisome Discoveries Regarding Patient Care at St. Agnes Health Care and Rehabilitation Center
The Illinois Department of Health and other private health inspection firms conducted a survey on the level of health care patients receive from the staff and personnel of the health center. The survey brought to the surface, cases of poor patient supervision and abuse which could be construed as nursing home negligence. The nursing home attorneys at Rosenfeld Injury Lawyers LLC reviewed these findings and outlined the following as episodes of poor patient supervision:
- Failure to implement interventions to prevent falls: “Since admission, R1 has had two falls. The first fall occurred on 12-21-09, at 1:10pm. The facility incident report indicates that R1 was “found sitting on the floor next to the bed, and that no apparent injuries resulted from the fall.” The second fall occurred on 12-27-09 at 6:10am. The facility incident report indicates that R1 was found “lying on the floor, next to the bed, on her left side.” Further description indicates that R1 was ” holding her left shoulder, complaining of pain, and that the left shoulder appears swollen and bruised.” R1 was taken to the local hospital. Further review indicates that prior to admission, R1 had multiple falls. The facility Fall Risk assessment dated [DATE] identified R1 as a high fall risk. The facility SideRail assessment dated [DATE] identified the need of siderails up x 2 while in bed to promote mobility and safety. Review of the Fall CarePlan dated 12-21-09 indicates that the siderail intervention was not added onto the careplan until 12-28-09. These failures resulted in a resident injury which consisted of a left displaced, left humeral surgical neck fracture and fractured ribs 4-7.”
- Failure to accurately assess and analyze the circumstances of falls: “From 5/15/11 through 5/23/11 R6 fell four times and injured herself repeatedly. The Fall risk assessment (Criteria for Assessment) was score 28 (05/22/11, 05/23/11, 05/29 /11 and 06/01/11) and high risk. E3 (Director of Nurse) on 06/29/11 at 11:30 am in the conference room stated,” The residents care plan and assessment should have been revised or updated. The resident should have been reassessed to prevent further fall and effectiveness of the intervention.”
- Failure to ensure call lights are within the residents’ reach: “On 1/24/11 at 12:30pm upon observation the call light for R8 was noted tied to the side rail of the bed. Upon interview, when asked if he was able to reach the call light R8 stated “no“. R8 attempted to reach the call light but was not able to do so. On 1/25/11 at 1:15pm upon interviewing R8, the call light was noted not to be within the resident’s reach.”
- Failure to prevent medication errors: “During medication pass observation on 01/26/11 at 10:35 AM, E4 ( Nurse) medications to R25 per [DEVICE] (Gastrostomy tube) which included [MEDICATION NAME] 500 mg one tablet, [MEDICATION NAME] 500 mg one tablet, Vitamin C 5 cc, [MEDICATION NAME] 2.5 cc and [MEDICATION NAME] 5 cc. (nurse) crushed the [MEDICATION NAME] and [MEDICATION NAME] tablet and placed them into a plastic container. E4 then flushed the [DEVICE] with water, took out the syringe plunger and poured the crushed medication that was mixed with water into the syringe. E4 proceeded to throw the cup to the garbage can and put back the syringe in its holder. E4 said that he was done giving medications to R25. Surveyor took the plastic cup from the garbage can and showed to E4 that there were still remaining crushed medications in the plastic cup and also in the syringe. E4 stated” that why I always asked for liquid medication.” Resident did not get the whole doses of the crushed medications.”
