The Sordid findings on the Level of Patient Health Care received at Smith Village

The annual/bi-annual inspection and surveys carried on Illinois nursing homes by the Illinois Department of health and some private inspection organizations showed that patients admitted to this rehabilitation center received poor health assistance and were victims to neglect and in more severe cases, physical abuse. The Rosenfeld Injury Lawyers LLC put its experienced nursing home attorneys on the case and a review of the findings of ProPublica—a private health surveyor—and found the following situations:

  • Failure to investigate injuries of unknown origin:  “R5 has experienced five recent falls according to the incident reports: 4/18/11, 5/2/11, 5/23/11, 8/18/11, and 9/17/11.  Review of the clinical record indicated that on 6/30/11 at 2:30 AM, it was reported that R5 had a bruise to the right wrist and discoloration to the right medial forearm at the elbow. Per documentation, R5 was unable to state details related to the bruises. Review of the Occurrence Reports did not contain one for these bruises or for this date. On 10/07/11 at 9:30 AM E6, ADON (Assistant Director of Nursing) was requested to present the investigative report for R5’s bruising of unknown origin. On 10/07/11 at 10:00 AM, E6 said that there was no report and the incident had not been investigated.”
  • Failure to implement pain management plans: “On 10/6/11 at 11:10 AM, R3 was sitting on a wheel chair in her room. R3 was grimacing as she held her left foot. The sole of the left foot appeared inflamed with a reddish-purple color which continued in splotches on the top of the foot and midway up the calf. The toes on the left foot were slightly swollen. The sole of the right foot had the same discoloration but not as intense in color and not as widespread. R3 complained that both feet hurt, but the left more than the right. R3 complained that the left foot was, “as cold as ice and very painful.” R3 rated the pain as a 10 on the pain scale of 1-10. R3 described the character of the pain as throbbing and getting increasingly worse each day for the past three months. E3 also stated that the pain became was worse after lying down in bed then getting up. On 10/6/11 at 11:20 AM, E6, DON (Assistant Director of Nursing) arrived in R3’s bedroom and assessed R3’s feet. E6 agreed that the left foot appeared worse than the right foot. E6 donned gloves and examined both feet. E6 agreed that the soles appeared inflamed and discolored with swelling to the toes of the left foot. During the exam, it was noted that capillary refill was delayed. E6 stated that she was not aware of the condition of R3’s feet, nor was she sure of anyone else being aware. E6 stated that she would call R3’s primary physician about the condition of R3’s feet and complaint of pain.”
  • Failure to ensure residents are free from unnecessary medications: “R12 admission records notes the following: R12 is a [AGE] year old female admitted to the facility with the diagnosis which includes [MEDICAL CONDITION],, legally blind, joint and leg pain, [MEDICAL CONDITION], difficulty walking, nodule goiter and [MEDICATION NAME] degeneration. Observations of R12 on 10-5-11 at 9:30AM in the dayroom, R12 had her head down not responding to any of the activities in her immediate surroundings. Review of R12’s MAR notes the following: [MEDICATION NAME] .5 mg (anti-anxiety) by mouth three times a day. Review of R12’s clinical records, physician notes and consultation notes shows there are no medical or mental health reason as to why R12 is currently taking anti- anxiety medication.”
