The periodic nursing home survey carried out by private health inspection firms and the State Department of Health, discovered poor patient care, inadequate patient supervision and cases of abuse which can be construed as patient negligence.   • Failure to develop an abuse policy containing all required components:  “The facility presented their policy and procedure on abuse prevention on 5/24/10 at 11:05 AM. This policy was reviewed and did not contain all the 7 components of abuse prevention (screening, training, prevention, identification, investigation, protection, reporting). The facility presented a second policy and procedure on abuse prevention on 5/24/10 at 11:25 AM. According to E1 (Administrator) this is the facility’s complete policy and procedure regarding abuse prevention. This policy also did not contain all the 7 components as required. E1 was informed of this concern. The facility presented a third version of the facility policy and procedure regarding abuse prevention on 5/24/10 at 1:30 PM. Per E1, this is the final version and that all the required components are written in the policy. According to E1 the abuse prevention policy and procedure is kept in the computer and retrieved from there. This policy was again reviewed by the survey team. This policy did not contain all the 7 components as required. The concern regarding the facility’s policy and procedure was addressed during the daily meeting with the facility on 5/24/10 at 4:00 PM.”
  • Failure to develop a care plan for falls for at risk residents: “R16 has a history of falls with injury: 5/25/10, 11am in room, right femur pain; 5/3/10, 9:45pm in room, bruise to forehead and right shoulder; 3/2/10, 12:15pm in room transferring
    4pm bleeding/laceration. No care plan was observed in the resident’s clinical record for falls.”
  • Failure to follow a physician order: “Review of R12’s current POS (Physician Order Sheet dated 5/4/10 shows an order for [MEDICATION ORDERS REDACTED]”Blood glucose monitoring twice daily & record – below 100 or above 200 call M.D..” From February 2010 through May 23 2010, R12’s glucose monitoring record shows 30 different days during which R12’s glucose level was below 80.  On all of those days, the facility showed no evidence that the order to call the physician for a blood glucose level below 100 was followed as order.”
  • Failure to provide adequate supervision: “Incident reports were reviewed, on 4/16/10 at 12:30 A.M., R2 was found in his room with several other residents with a crack pipe. The other residents were not identified in the report. R2 denied smoking crack at this time. A drug test was done on R2 on 4/16/10. The drug test came back positive for crack cocaine. Further review of R2’s records shows no evidence of updated drug abuse assessment. There was also no care plan/treatment plan in place to address R2’s for intervention was found in R2s clinical record. The facility failed to monitor R2 who was identified by the facility as having history of substance abuse to ensure that the resident does not use illegal substance while in the facility.”
