Concerning Discoveries Regarding Patient Care at Presence Saint Benedict Nursing & Rehab

The Illinois Department of Health and other private health inspection firms conducted a survey on the level of health care patients receive from the staff and personnel of the health center. The survey brought to the surface, cases of poor patient supervision and abuse which could be construed as nursing home negligence. The nursing home attorneys at Rosenfeld Injury Lawyers reviewed these findings and outlined the following as episodes of poor patient supervision:

  • Failure to provide a hazard free environment: “On 6/27/11 at 10:50am, the surveyor and E5 (RN, Registered Nurse) entered the room of R11 the resident was lying in bed with the bed alarm turned to the off position. E5 turned the alarm on after it was brought to her attention. The floor mat was located at the foot of the bed instead of on the floor near the resident. The care plan for R11 documents: Problems: Resident is at risk for falls, Cognitive and memory deficits; not aware of safety needs.”
  • Failure to administer medications at the time ordered: “On 6/27/11 at 12:35pm, R26 was in the dining room eating her lunch. E8 (nurse) had the resident removed from the dining room and taken to her room for an insulin injection. After the injection was given, the resident was returned to the dining room. This medication is to be given 5-10 minutes prior to a meal per manufacturer’s directions because of the rapid onset of the insulin. On 6/27/11, R27 was in the dining room eating her lunch. E8 was asked by staff to go to her room to receive her insulin injection. The resident stated she wanted to finish her lunch first. When R27 was done eating, E8 administered the insulin. This medication is to be given 5-10 minutes prior to the meal per manufacturer’s directions because of the rapid onset of the insulin. E8 did not have an explanation for why the insulin was given at that particular time for these two residents.”
  • Failure to communicate a change in condition to the physician: “Nurses notes from E4 on 7/2/12 at 7:00 PM state, “small emesis. Feeding held for 2 hours. No constipation after rectal examination.” Nurses notes on 7/3/12 at 3:00 PM document R3 is again complaining of nausea and Z2 (physician for R3) is paged. At 7:00 PM the nurses note indicate physician has not returned the phone call. The next nurses note is on 7/5/12 at 6:32 am, R3 has another emesis. Z2 returns the call and an x-ray is ordered stat. X-ray results show R3 has a moderate colonic ileus. R3 was sent to the emergency room for an evaluation. On 7/12/12 at 10:15 am Z2 (Physician for R3) stated, “They could have paged medical director if no call back.” On 7/12/12 at 3:00 PM Z1 (Medical Director) stated, “I was not called on this matter.”  Facility policy states that if the attending physician cannot be contacted; an alternate physician should be contacted.  If that fails, the Medical Director of the facility should be notified.”
