Critical Findings about the Patient Care received at Presence Maryhaven Nursing & Rehabilitation

According to the data gathered from the nursing home surveys conducted by the Illinois Department of Health and other survey agencies, there have been noticeable signs of abuse and neglect at The Presence Maryhaven Nursing & Rehabilitation, which can be construed as nursing home negligence.

This prompted Rosenfeld Injury Lawyers to review the data compiled by ProPublica –a nursing home survey organization—and we found out that the following experiences by patients –outlined below—, can be interpreted as situations of nursing home negligence:

  • Failure to develop a care plan to address all of a resident’s needs: “Based on observation, interview and record review, the facility failed to develop comprehensive care plans for pain, wound, fall risk and self-care deficits for R3.  On 7/12/11 at 9:25 AM, R3 was awake in bed and groaning. Review of the chart for R3 revealed no care plan for pain management. The admission assessment for skin and wounds for R3 dated 7/8/11 indicated there was a wound at the PEG tube (feeding tube) site. There was no care plan in the chart for wound care. E4 stated that R3 tries to climb out of bed, and slides to the sides of the bed. E4 said that R3 has side rails up so that she doesn’t fall from the bed. There was no fall risk care plan found.”
  • Failure to effectively monitor residents identified as wanderers: “This failure resulted in an Immediate Jeopardy when on 6/21/11, R2 wandered into R3’s room which resulted in R2 and R3 pushing each other, and causing R2 to fall to the floor sustaining multiple injuries. R2 sustained a laceration to the lip, fractured right orbital floor, subarachnoid hemorrhage, traumatic subdural hematoma, and multiple contusions.  R2 was transferred to the hospital and later discharged back to the facility on [DATE]. On 6/25/11 R2 was transferred back to the hospital due to lethargy and vomiting. R2 subsequently expired at the hospital on [DATE]. The facility did not supervise R2 to prevent her from wandering into R3’s room
    after being left unsupervised in the small dining room. R3 has a documented history of verbal and physical aggression to other residents, who wanders into R3’s room. The facility did not provide immediate supervision of R3 after the altercation with R2, to prevent potential risk of aggression towards the other residents on the unit.”
  • Failure to provide accessible call lights: “On 7/12/11 at 9:25 AM during initial tour, R3 was lying in bed and the call light was hanging over the side rails and out of reach. After surveyor prompting, E3 (RN) handed the call light to R3. At 9:50 AM, R25 was lying in bed and her call light was hanging on the side rail. When asked if she could reach the call light, R25 responded, “not good”. R25 attempted to grab the call light without success. E3 then handed the call light to R25.”
