A survey conducted by the State Department of Health and diverse private health inspection firms unearthed some episodes of poor patient supervision and inadequate patient transportation which led to the patient falling as well as other avoidable health issues. The survey conducted by ProPublica, was reviewed by our nursing home attorneys in Rosenfeld Injury Lawyers LLC and episodes of poor supervision which could be construed as nursing home negligence were found:
- Failure to provide adequate supervision to prevent avoidable accidents: “E4(CNA- Certified Nurse’s Assistant) said on 10-20-2011 at 3:10 pm that she works the PM shift and R1 was put on her assignment list that evening to even out the assignments. She said she transferred him to bed and the nurse started the admission. She stated that she left the room and went about her duties. She was assigned to the other side and went to those residents first. She never came back into the room. E4 said that when the dinner tray came the family was gone already. Supper is usually 5pm to 5:15pm and she did not know who put the overbed table in front of R1. She said when she came back in to the room the nurse was already there and the overbed table was moved. R1’s sheet had the spilled coffee on it. E4 said R1 had no roommate and was in the room alone.”
- Failure to provide functional chair alarms: “During the initial tour on 8/16/11 at approximately 9:45am with E9, Charge Nurse, R2 was observed by surveyor in her room standing in front of a chair by the bedside, using the over bed table for support, attempting to step forward. E9, was outside the room during this observation. There was a chair alarm attached to the chair. The alarm was not activated. R2 sat down on the chair and stood up again. The alarm did not activate. R2 was not within E9’s view and surveyor asked E9 to monitor this observed behavior. E9 proceeded to assess R2’s chair alarm and found it to be non-functional. E9 told surveyor that the alarm was non-functional and she will have it checked. E9 went on to say that staff is required to check all alarms at the beginning of each shift. Incident report shows R2 sustained a fall on 8/13/11 while attempting to self-transfer from chair to bed. According to the Report, the chair alarm was activated but staff could not reach resident in time to prevent the assisted fall. During a separate interview, E9 told survey team that the alarm was non-functional and was replaced.”
