Concerning Findings Regarding Patient Care at Norwood Crossing
According to data from nursing home surveys conducted by the Illinois Department of Health other agencies including ProPublica a private surveying institution, there have been numerous episodes of poor patient care at Norwood Crossing which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:
- Failure to provide adequate supervision to prevent avoidable accidents: “R3’s Minimum Data Set (MDS) dated 1/12/12 assesses R3 as “needing supervision/oversight, encouragement or cueing during meals”. R3 has dentures. R3’s quarterly nutrition review dated 8/12/11 documents “difficulty swallowing, self feeding but needs assistance”. No care plan was found to address the resident’s swallowing problem or swallowing recommendations, or that the resident needed assistance during meals. 1/12/12 at 5.25 PM, R1 was eating her dinner in the hallway on the 4th floor next to the dining room. E4 (Registered Nurse) observed resident was up in chair when E4 noticed R1 with a large amount of bread sticking out of her mouth. Her face was red. R1 could not speak. E4 performed the Heimlich maneuver several times with no success. Resident was placed on the floor and Heimlich thrusts were done. 911 was called. A small amount of food was removed from mouth. An Ambu bag was used to increase oxygenation. Resident coughed and expelled a small amount of undigested food. Paramedics arrived and suctioned resident, an IV was started and R1 was transported to the hospital. Z1 (Medical Director) stated on 3/29/12 that R1 expired from Aspiration and Cardiovascular Collapse in the hospital. Z1 did not provide any further information. The facilities dietary spread sheet week 3, day 5, (1/12/12) documents that a fresh orange wedge was included in the dinner menu for the mechanical soft diets. The diet manual for the facility recommends only canned citrus sections should be served to mechanical soft diets, and to avoid fruits with a tough skin. The facility failed to correctly prepare a menu to avoid fruits with a tough skin in its mechanical soft diets.”
- Failure to provide proper treatment to residents with reduced range of motion: “R3’s Physician Order Sheet dated 12/20/11 indicated that Z1 ordered to discontinue R3’s right Ankle Foot Orthosis (AFO) until her pressure sore is resolved. On 12/31/11, Z1 ordered to resume R3’s use of right AFO during the day, and off during the night. R3’s Treatment Administration Record indicated that despite above order, R3’s nurses continued signing the area that indicates R3’s right AFO is applied continuously.”
- Failure to ensure the rate of medication errors is below 5%: “On 8/26/10 on the 2nd. floor E4 (Registered Nurse) was observed administering medication to R30 at 11:30am. After reconciling the medication in R30’s medical record the following medications have orders to be administered at 9am and 5pm. The following 9am medications were given at 11:30am. Isorbide 20mg. (milligrams), [MEDICATION NAME] Sulfate 325 mg., [MEDICATION NAME] 25 mg., Potassium Chloride 10 milliequivalents, and Levetiracetam 250mg. The above medications are used for heart problems, blood pressure and [MEDICAL CONDITION] control. E4 was observed administering medication at 11:50am. to R13. After reconciling the medication in R13’s medical record the following medication were ordered for 9am and 9pm. [MEDICATION NAME] 150 mg. and Levetiracetam 750mg.”
