Each year, thousands of nursing home residents suffer serious injuries and death as a result of medication mistakes by those in charge of providing them care. The personal injury attorneys at Rosenfeld Injury Lawyers LLC have handled many cases where victims have received the wrong drug or the right drug with the incorrect dosage. Others have suffered immediate injury or death through an allergic reaction to medications or when drugs are given to the resident in a dangerous combination that produces adverse effects to their overall health.
Medication errors are preventable problems that can be easily avoided if staff members of the nursing facility follow procedures and protocols. Other times, the mistakes are made due to the physician’s illegible handwriting, the similarity of medication names, incorrect prescriptions and other serious problems.
Our team of lawyers remains committed to providing numerous legal remedies for medication error victims residing in nursing facilities. We fight aggressively for our clients to ensure that the facility or individuals responsible for causing the victim harm are held legally and financially accountable. In addition, we routinely publish valuable publicly available information that outlines the safety concerns, health violations, opened investigations and filed complaints against nursing facilities statewide. We provide this information as an effective tool for many families faced with the need to place a loved one in a nursing home.

On average, the ranking for quality measures, health inspections, and staffing were determined by surveyors and inspectors during routine surveys and unannounced inspections at the facility.
The North Aurora nursing home neglect attorneys at Rosenfeld Injury Lawyers LLC continuously monitor filed complaints, opened investigations and safety concerns involving nursing facilities including North Aurora Care Center. Some of these concerns include:
- Failure to Maintain a Rate of 5% or Less in Medication Errors at the Facility
In a summary statement of deficiencies dated 08/27/2015, a state investigator noted a deficient practice during an annual licensure and certification survey concerning the facility's failure to "administer medications as ordered.” The investigator noted that the facility had 29 opportunities during the survey to properly administer medication but failed four times producing a 13.79 percent error rate.
In one incident, the surveyor noted on 08/26/2015 there was a problem with a resident receiving their medication in the proper dosage according to the physician’s orders. The surveyor noted that the resident was not receiving Quetiapine, a medication used to treat behavioral problems with older individuals with dementia, as per ordered in the morning, and “was probably receiving both dosages at night.”
In a separate incident, the surveyor noted that the Licensed Practical Nurse at the facility improperly administered blood glucose medication according to the physician’s orders. This involves an incident at 4:16 PM on 08/24/2015 when an LPN administered two pots of the resident’s medication using a microgram inhaler. During the administration of the medication, the resident was given consecutive puffs on the inhaler “with only 10 seconds between puffs.” However, according to the label on the medication, it was revealed that the medication should be given as “one puff twice daily.”
Many facilities, like North Aurora Care Center, failed to follow protocols and procedures when prescribing, dispensing and dosing medications to their residents. In some cases, miscommunication between the pharmacist and physician leads to serious harm or death of the nursing home resident. This includes a failure to guard against dangerous drug interactions, drug allergies, and potential side effects. Other cases involve mislabeled drugs, a failure to follow protocols, leaving drugs on the medication cart open and available to other residents and visitors.
