A serious but all too common consequence of a car accident is a traumatic brain injury (TBI). They can leave you or a loved one critically injured with constant headaches or even worse after a car or auto accident.

They can leave you unable to perform daily tasks due to a constant headache after a car accident or motor vehicle collision. You will not enjoy life the same way or perform many of the same tasks because of the blow to the head from the car crash.

Rosenfeld Injury Lawyers works with motor vehicle accident victims, including those with a traumatic brain injury or headache after a car accident (i.e., post-traumatic headaches).

When we represent accident victims who have suffered severe auto accident injuries such as a brain injury, concussion, post-traumatic headache, or another head injury, we know they need every resource the law can offer.

However, it is not always easy for car accident victims with constant headaches or similar personal injuries (i.e., head pain, headaches, etc.).

The evidence may be hard to obtain and prove. Sometimes the motor vehicle accident defendants are unwilling to cooperate even though they were at fault for the accident and subsequent head pain, constant headache after a car accident, head injury, post-traumatic headaches, or brain injury due to the accident.

The following sections highlight some issues that arise in car accident lawsuits with brain injuries and other types of injuries.

Constant Headaches After Car Accidents

Constant headaches after a car accident can be indicative of anything from a minor injury to a traumatic brain injury (TBI)

How a Traumatic Brain Injury and Other Brain Injuries Occur in a Car Accident

Doctors are still studying what happens to the head during an auto wreck (rear end, head-on, etc.). Many severe head injuries (concussion, headache, headaches, etc.) sustained in it are difficult to detect, even if they seek medical care or medical attention.

Victims show no symptoms (i.e., headache, neck pain, light sensitivity, pressure across the forehead, chronic headaches, facial trauma, high blood pressure, constant head pain, spine disruption, minor suffering, migraine, etc.) until the damage is done.

A doctor must use extensive imaging tests to spot them; insurance companies do not cover many for the subsequent treatment.

Below are some of the common causes of head trauma from these events. Our Chicago auto accident lawyers help them every day.

  • Contact with an object. Victims’ heads bang on steering wheels, airbags, or the ground. Motorcyclists are especially at risk of these injuries. This is true because of the limited protection when riding their bikes.
  • Forward momentum. The brain doesn’t need to hit a foreign object in an accident. It may strike the front or back of the skull. Brain matter is suspended within the skull. It can bounce around during sudden and rapid deceleration. This can result in internal swelling. Microtears develop that are only detectable through imaging scans.
  • Unspotted concussions. It is essential to look for concussions properly. These injuries can lead to severe complications if untreated. The initial symptoms can last mere minutes. That makes them more challenging to detect. You might need further tests if the symptoms have passed quickly.
  • Contact with the floor. Drivers are often thrown from their vehicles. They hit the ground in some matter. A helmet only offers a limited form of protection. It is essential to see a doctor soon after these events.

You may be dealing with many mild or drastic injuries after a rear-end crash- or any impact- including neck sprains, whiplash, chronic constant headaches, one-time headaches, or similar suffering.

If this does occur, you should remember a few things to protect yourself-both legally, medically, professionally, and personally.

  1. See a doctor. Your physician can alleviate your suffering, offer appropriate treatment, and record your pain for future usage.
  2. Talk to an attorney. An attorney can begin the process of recovery and legal compensation.

  4. Record your memories.

The pair’s injuries were not minor. The woman fractured her vertebrae (more than $48,000 in medical expenses).

The man suffered a traumatic brain injury, constant headaches, neck pain – whiplash subdural hematoma, and cervical bone fracture at the C4 and C5 spots.

Doctors performed surgery on his brain and spine (more than $700,000 in medical expenses).

The couple brought an action against the trucker’s company and leasing company, but the court did not decide.

They settled for $2.9 million-$2.75 million for the man and $150,000 for the woman.

$1,100,000 TBI Settlement:

This unfortunate incident was as consequential as avoidable. A truck driver was hauling a big rig too large for his frame when he ran a red and T-boned a 79-year-old woman in Winnebago County, Illinois.

The woman suffered a traumatic brain injury, neck bruising, constant headaches, whiplash, broken hip, fractured wrist, damaged pelvis, cut open spleen, and left pneumothorax.

Doctors had to perform immediate surgery, but long-term rehabilitative care was also required (medical expenses were north of $750,000).

The subsequent claim against the driver was routed to the insurance company, Progressive, which eventually settled the matter for $1.1 million.

$350,000 Head Injury Settlement:

This multi-car accident started when a truck driver lost control of his semi-truck tractor-trailer.

Five other cars, including the plaintiff’s passenger vehicle, were brought into the chain-reaction crash. He was a construction manager in his late thirties.

Immediately, the automobile crash caused him a traumatic brain injury, constant headaches, and shoulder damage. Long-term, it resulted in memory loss, tinnitus, dizziness, and vision loss.

He lost over $20,000 in lost wages and over $60,000 in medical expenses due to the event.
