As lawyers who frequently represent families in nursing home negligence and medical malpractice cases, we know overwhelming the the situation can be from both an emotional and financial perspective.  Complicating the situation even further was the fact that families were typically not given an opportunity to access their loved ones medical charts without seeking court involvement.

 New Legislation In Illinois To Assist Families In Obtaining The Medical Records Of DeceasedThankfully, the Illinois legislature recognized this significant hardship put upon grieving families and introduced legislation to streamline the process of obtaining the medical records for the deceased.  This legislation will add much needed transparency to situations where a family has questions concerning the suspicious care of a loved one– or even if they wish to obtain the records for other purposes.

The new legislation provides: 735 ILCS 5/8-2001.5 

With a significant portion of the hip replacement market and a significant failure rate, the recall of DePuy’s ASR™ XL Acetabular Hip System and DePuy ASR™ Hip Resurfacing System have received a significant amount of attention both in the press and from consumers.  While these concerns are indeed justified, it is important to note that there are other hip replacement devices— with similar defective metal-on-metal designs— which may give rise to potential legal claims in individuals who have had the devices implanted.

Investigation Of Metal Hip Replacement DevicesThe breadth of medical complications associated with metal-on-metal hip replacement devices is unique in that one device may produce several types of problems.  A significant number of metal-on-metal hip replacement complications include: dislocation, pain, swelling, premature device failure and metal poisoning (cobalt and chromium).  Depending on the complaint and the overall health of the person involved, many of these metal-on-metal hips require ongoing monitoring or surgical removal.

Our team of hip recall lawyers has initiated legal action on behalf of a number of clients with defective DePuy products.  It is important to remember that people with other types of hip replacements may have similar legal claims against their respective manufacturers.

Pedestrian Struck By Vehicle Policy LimitsRosenfeld Injury Lawyers LLC is proud to announce the settlement of a Chicago personal injury case involving a pedestrian injury on the City’s Southwest side.  Our client was a pedestrian who was crossing Cermak Road, near the intersection with Hoyne at approximately 3:20 p.m. on August 5th of this year.  As he was making his way across the street— within the intersection, he was struck by a car going eastbound on Cermak Road.  Our client, a man in his 50’s, suffered head and back injuries that required care at Mt. Sinai Hospital.

Chicago Police officers and paramedics were called to the scene where they provided medical care and conducted an investigation into this vehicle – pedestrian incident.  After reviewing the information provided to them, the driver was cited for violating the Chicago Municipal Code related to pedestrian safety.

For parents coping with the complexities associated with a child who has been diagnosed with cerebral palsy or other birth injury— every aspect of life changes to accommodate the needs of the child.  At some point, whether its in the days following birth or after years watching their child struggle to achieve developmental milestones, many parents begin to wonder how or why the condition developed in the first place.

Understanding the specific reasons behind the development of cerebral palsy in a child can be an ever evolving process that frequently requires the input of several physicians who have training in specific fields.

Our experience working with families with children who have cerebral palsy, Erb’s Palsy and other birth injuries has indeed opened our eyes to the expanse of questions that frequently accompany each phase of the child’s development.  With the creation of Cerebral Palsy FAQ, our goal is not only to assemble a compilation of frequently asked questions concerning CP— but also to provide families with the resources so they can access information about their child’s unique situation.

For the second year, Rosenfeld Injury Lawyers LLC is happy to sponsor an community outreach event for children on Chicago’s Southwest-side.  The event is organized by Help-in-hands, an organization devoted to improving the communities for children. Last year was such a blast, that we brought back the pony rides!

In June, 2011 the FDA ordered Takeda Pharmaceuticals, the manufacturer of Actos to begin putting a warning on the drug label advising people of the strong correlation between Actos use and the development of bladder cancer.  The warning comes shortly after Actos was banned altogether in France and Germany when other long-term studies identified similar concerns suggestive of the increased badder cancer risk.

correlation between Actos and bladder cancerActos (pioglitazone) has exploded in popularity as medication used to treat Type 2 diabetes after safety concerns were raised about heart damage in diabetic patients taking Avandia.  As a member of a class of drugs known as thaizolidinediones (TZD’s), Actos helps to treat diabetes by increasing the bodies sensitivity to insulin.

The past year has been devastating for individuals who have received defective DePuy hip replacement products.  Almost a year ago, the FDA announced a recall on the popular DePuy products ( the DePuy ASR XL Acetabular System and DePuy ASR Hip Resurfacing System) due to high product defect rates.

At issue is both the design of the hip as well as metal-on-metal construction of the product.  In some patients, the design has resulted in repeated dislocation of the hip prosthesis.  Other patients have been injured when metal from the DePuy hip splinters off and becomes embedded in the tissue surrounding the joint.  Yet a third type of DePuy injury is emerging as some patients suffer metal poisoning as their bodies absorb bits of the Chromium and Cobalt used in the manufacture of these devices.
