In order for a plaintiff’s attorney in a medical malpractice case to move the court to settle an argument with defendant’s counsel or do anything, it must file, argue and win a motion. These can be filed at any time during the case-even after it. Motions in limine are a special brand of motions whereby the attorney asks the court to preclude or minimize the appearance of certain things such as evidence or testimony from entering the courtroom. Common motions for medical malpractice cases include motions to bar witnesses from serving as experts in testimony, motions to prohibit the introduction of evidence regarding the plaintiff’s past, and even motions to summarily end the trial.
