Clergy Sexual Assault – An Ongoing Problem

In 2017, Maryland legislatures changed the laws to provide more accessible pathways for men and women who were sexually assaulted when children and want justice. The changes make it easier to file civil lawsuits against institutions that harbor abusers, including predatory priests.

However, the law may have immunized the Catholic Church and other religious organizations from legally producing records it has hidden for decades.

The provision primarily protects the Roman Catholic Church and other religious ministries from facing massive lawsuits filed by those who were sexually abused by priests decades ago.

Victim Justice

In 2016, Roman Catholic Church Baltimore Archdiocese resolved numerous cases involving sexual abuse by Reverend Maskell, who decades ago had served young parishioners at Archbishop Keough High School. While some of the sexual abuse incidents occurred decades ago, more recent assaults took place as late as 2011.

Maryland statutes protect anyone alleging they were victimized through sexual abuse when a child so they file a civil lawsuit up until when the survivor turns twenty-five years of age. There is no statute of limitations on criminal charges involving child sexual abuse.

While the statute of limitations expired years ago in all cases involving Maskell, the Archdiocese still offered victims a financial settlement to cover much-needed counseling. While some of the predatory priest’s victims were males, most were females.
