According to the data gathered from the nursing home surveys conducted by the Illinois Department of Health and other survey agencies, there have been noticeable signs of abuse and neglect at the Manorcare of Palos Heights East, which can be construed as nursing home negligence. On examining the records, our nursing home attorneys discovered the following:
- Failure to maintain residents’ dignity: “During the medication pass on 1/12/11 between 9:20am and 3:30pm. E4 (LPN) failed to knock on R19 and R25’s room before entering to administer medications. E5 (LPN) entered the room of R26 twice without knocking on the door, checked the blood sugar level of R26 without closing the door to provide privacy. E7 (RN) and E8 (RN) administered insulin injection on R18 and R28 respectively without closing the door or drawing the privacy curtains. E6 entered R27’s room without knocking, checked the gastrostomy tube ([DEVICE]) placement and administered [MEDICATION NAME] via [DEVICE] on R27 without closing the door or drawing the privacy curtains. E4, E5, E6, E8 and E9 (RN) all stated they are expected to knock on residents’ door before entering and to provide privacy when rendering care, giving injections, checking [DEVICE] placement and administering medication via [DEVICE], by closing the door and drawing the privacy curtains.”
- Failure to adequately assess pain and provide pain relief interventions: “On 12/27/11, at 10:25am, R2 was sitting in the wheelchair in the room. R2 stated that sitting in the wheelchair causes increased back and right hip pain. R2 asked E9 (Nurse) to locate the CNA to put R2 back to bed because of back and right hip pain and discomfort. E9 did not evaluate R2’s pain using the pain scale or any other type of assessment. On 12/29/11, R2 stated that the pain medication ordered is not effective and that the nursing staff does not always ask what R2’s pain level is before the 9am and 9pm pain medication doses and during the day. R2 stated that pain is usually between 7 and 10 on the pain scale the past few days, and sometimes higher, throughout the day. Review of December Medication Administration Record [REDACTED]’s rating of pain ranges from 3 to 6 on the pain scale. This is not at or below R2’s goal of 2 and no additional pain medication was given for 2 days, December 28 & 29. There is no documented evidence that R2’s pain level was evaluated throughout the day and that the effectiveness of the pain medication was evaluated.”
- Failure to prevent medication errors: “During observations of the medication pass with E10 (nurse) on 12/27/11 at 3:45 PM, E10 was observed to flush R2’s double lumen midline venous access device. E10 was further observed to administer [MEDICATION NAME] 2 gm in 100 ml of sodium chloride. A review of R2’s clinical record documents that on 12/16/11, R2’s [MEDICATION NAME] dose was changed by the physician to [MEDICATION NAME] 1 gm intravenous every 24 hours. E10 was also observed to administer [MEDICATION NAME] two puffs to R2. E10 was observed failing to allow any interval between the puffs.”
