Episodes of Negligence Discovered at Lexington of Wheeling

According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous episodes of poor patient care, inadequate supervision and physical abuse at Lexington of Wheeling which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to investigate and report incidents of  abuse or neglect: “On 3/16/11 two residents (R30, R31) reported to the Social Services Designee (E20) that they had concerns about (E21) CNA (Certified Nursing Assistant). Both residents stated that E21 had been rude and hostile and had refused to provide asistance to them. Review of the facility reportable abuse and neglect file showed that there was no evidence that the incident was ever reported to the Illinois Department of Public Health (IDPH). On 3/30/11 at 7:30am, a resident (R29) was found in bed with blankets tucked in a way that restricted movement. The incident was reported to nursing staff immediately. Review of the facility’s reportable abuse and neglect documentation showed there was no verifiable evidence that the incident was reported to IDPH. On 5/23/11 a resident’s (R30) daughter reported to Social Services staff at about 7:45pm that on 3/21/11 a CNA answered her mother’s call light by responding you can’t have a shower. Both the resident and family member informed the CNA that R30 needed to use the bathroom. According to R30’s daughter R30 remained on the toilet for 45 minutes before the CNA returned. Review of the facility abuse and neglect records indicated that the incident was reported to IDPH initially, but the final investigation wasn’t reported until 5/31/12, ten days after the incident was reported.”
  • Failure to assist residents who need total help with eating/drinking: “February 9, 2011 at 9:30 a.m. during the initial tour with (E8) Social Service Director (SSD) there was 15 residents in the dining room with their breakfast sitting in front of them. The 3rd floor has 74 residents, many with a [DIAGNOSES REDACTED]. The breakfast was brought to the 3rd floor at 7:30 a.m. and lunch at 11:30 a.m. From 930a.m. to 9:50 a.m., 15 residents were still sitting at the tables with no staff present and their food sitting in front of them 2 hours and 20 minutes later. February 9, 2011 from 12:00 p.m. to 12:50 p.m. while observing lunch, the same 7 residents mentioned above did not have any food or beverages in front of them. Lunch was served at 11:30 a.m. and many of the residents on the 3rd floor were eating. The writer asked for (E1) Administrator and (E2) Assistant Administrator to please come and observe that 7 residents still have not been served their lunch at 12:40 p.m. All 7 residents are unable to feed themselves and require total assist/care from staff.”
  • Failure to adequate supervision to prevent serious injury: “Admission assessment since November 2008 under RAPS (Resident Assessment Protocol Summary) documents, “# IV Impact on the Residents Overall Functioning: “Impaired decision making, poor safety awareness, increased risk for falls.” Nurses notes dated 3/13/09 at 4:30PM documented, “Resident seen walking in the hallway holding at the railings with no distress. With occasional bouts of confusion, forgetfulness and weak. Redirected and reoriented to stay in his room and wait for dinner to be served… 6:25PM: “Resident was seen lying in the hallway opposite of his room. He was close to the wall, with the left side of his body on the floor and noted to be bleeding in the left side of his head. Resident c/o (complained of) L (left) hip pain.” R2 was transferred to hospital emergency room to R/O (Rule out) Head injury and left hip fracture during this incident. 10 PM DX (Diagnosis) R Femur Fracture.” Record reviews showed that the facility had no reassessment, new interventions, nor update of care plans for falls from the incident fall on 3/13/09.
  • Failure to implement interventions to prevent elopement: “On 7-25-12 at 3:45 p.m. the Wheeling Police Department made a call to the facility speaking with E3 (Administrator) informing her that they had found R3 wandering around the residential area of Wheeling which was approximately 1 mile from facility. Facility staff not aware that R3 even left the facility. R3 was escorted back to the facility by Police Officer. Body check done; no harm to R3. The facility is located on a major four lane street with a speed limit of 40 miles per hour.”
