The Appalling Findings Regarding Patient Care at Lakefront Nursing & Rehabilitation Center
According to data from nursing home surveys conducted by the Illinois Department of Health other agencies including ProPublica, there have been numerous episodes of poor patient care at Lakefront Nursing & Rehabilitation Center which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:
- Failure to ensure allegations of theft are thoroughly investigated: “According to R9 on 4/20/10 at 2:30 PM, last month (3/10) she came into her room from outside. R9 said, she placed $ 20.00 in her purse and closed it. She placed her purse on top of her bed. E12 (Certified Nursing Assistant -CNA) came in and sat on her bed on top of her purse. R9 then saw E12 hold a puzzle book over R9’s purse in what appeared to be trying to conceal the purse. When R9 asked E12 what she was doing with her purse, E12 placed it down on the bed. R9 then opened her purse as soon as E12 left the room and found $20.00 missing. R9 said she did not report to the facility that day for fear of reprisal because of previous experience in another facility. R9 approached E11 (CNA Supervisor) the following day about the incident. E11 then spoke to E12 and counseled her to return the $20.00 to R9. E11 then informed E1 (Administrator) about the incident. R9 stated that E1 did not tell her if an investigation was conducted nor was she informed of the outcome. E1 stated that he spoke with E12 who denied taking the money but gave R9 $20.00 anyway and that R9 was satisfied. E1 also stated, E10 (Social Service Director) informed him about the incident after talking with E12. E1 acknowledged that he did not investigate further because R9 did not actually see E12 take her money. E1 stated he did not think the incident fell under abuse.”
- Failure to promptly assess and treat pressure sores: “Upon repositioning, there was an 8.1 X 10.5 cm Stage II pressure sore on the Right Trochanter. E7 told surveyor that this wound was not there before, and asked R5 ‘how did this happen?’ E7 said he would contact R5’s physician for an order to treat. E11, Certified Nurses Aide Supervisor, told surveyor that Certified Nurses Aide (CNA) conduct skin checks for all residents on shower days. R5 stated that he gets a shower three times each week, Mondays, Wednesdays and Fridays. E19, CNA, said he was the one caring for R5 on the previous day, 4/21/10, which was R5’s scheduled shower day. E19 stated he did not do a skin check on R5 because he showers himself and that R5 was waiting all day for his treatment to be done. The most recent skin check sheet dated 4/18/10 makes no reference to this skin breakdown on the Right Trochanter. E11 obtained an order from R5’s physician to begin treatment.”
- Failure to obtain background checks on new employees: “Based on interview and record review the facility failed to obtain timely health care worker background checks and or fingerprinting for 8 of 15 employees (E9 through E16) reviewed for health care worker background checks.”
- Failure to provide appropriate supervision and interventions to prevent falls: “R11 is a [AGE] year old male resident with [DIAGNOSES REDACTED].” Asked resident how he fell. He (R11) verbalized that he was way back to his room. He was in room on shower chair in front of closet trying to get some clothes from closet and shower chair went back and he hit his shoulder on the closet door and fell on floor. He got dime size skin tear and bruise.” On 6/16/11 at 3 PM during the daily status meeting R11’s fall was discussed with E1, Administrator and E2, DON (Director of Nursing). When questioned why R11 was left in his room unattended sitting on a shower chair in his room E2 replied, “Staff should not leave him unattended like that.”
- Failure to ensure access to a call light system: “On 4/22/10 at 12:00 PM, upon knocking in room [ROOM NUMBER], R16 requested the surveyor to tell the staff that he needed to be turned. The surveyor asked R16 to turn on his call light by pulling on the string. R16 tried twice but the light outside the room did not turn on. The surveyor then asked E8 (Licensed Practical Nurse) where the call light panel is. Room [ROOM NUMBER]’s light panel at the nurse’s station did not light and the call sound did not activate. R16 said that the call light does not work because he tried it before but unable to recall if he told anyone. E8 said she was not aware that R16’s call light was not operational.”
