In the United States, driver’s licenses are issued by individual states under their own laws. This system was created a way to ensure concepts of federalism were upheld in the U.S. and also because some states retain their own authority in some areas of the law. In 1899, Chicago and New York City were recognized at the first cities to provide driver’s licenses after drivers passed a test. The first states in the U.S., Massachusetts and Missouri, began issuing driver’s licenses in 1903.

Illinois eventually passed its driver license law in 1939 and did not require that drivers pass an examination until 1953. Prior to the enactment of this law, there were many states that did not issue drivers’ licenses. The Illinois Supreme Court even held that licensing requirements imposed on private individuals were unconstitutional. Many states followed Illinois’ lead until the Great Depression era. After the Great Depression, states began to impose license requirements and may have done so for revenue purposes.

Today, the Illinois Secretary of State is responsible for administering licenses under its Driver Services Department. The requirements for obtaining a license are:

  • Applicants must complete 50 hours of driving
  • Complete a driver’s education course
  • Show proof of enrollment in school
  • Retain a driver’s permit for 9 months before applying for a driver’s license
  • Individuals receiving a moving violation during the 9-month period must restart the waiting period
  • Individuals under 18 must honor the curfew requirements, which maintain no driving between 10:00 p.m. and 6:00 a.m.

The Illinois Vehicle Code

The Illinois Vehicle Code contains the specific requirements for obtaining a license, identification card or permit. The act maintains that every person must have a driver’s license to use the roads of Illinois. Recently, the Code was amended to allow undocumented immigrants to apply for and obtain driver’s licenses in Illinois. In addition, the act maintains a clear distinction between state regulations for licenses and municipal ordinances. Municipalities and cities may not override state law and require individuals to obtain additional licenses.

Some of the other notable points of the Code are:

  • Employee of the U.S. government or Armed Forces are not required to have an Illinois license while on official business
  • Nonresidents do not need Illinois licenses if they have a license from their own state or country
  • Individuals receive a renewal letter 60 to 90 days prior to expiration of a license
  • Individuals may need to fulfill other testing requirements for a renewal of a license, such as vision screening or a new driving exam (applicable for residents over 75)
  • Every eight years, everyone is required to take a written exam
  • Those without traffic violations do not need to take the written exam
