Any slip and fall of the nursing home resident can result in serious consequences. In nearly every incident, a falling accident with injuries could have been prevented had the nursing staff provided adequate supervision and assistance, especially to residents who require a higher level quality of care. Sadly, the Forsyth elder abuse attorneys at Rosenfeld Injury Lawyers have represented many nursing home residents who have suffered injuries and harm due to the negligent actions of their caregivers.
By law, the nursing facility has a legal responsibility to the resident to identify and assess the risks for falling. In many cases, slipping and falling in a nursing facility is often the catalyst to various other complications including the resident’s deteriorating health. Without appropriate measures and an effective plan of care developed and implemented by competent medical professionals, the victim can easily suffer a decline in their health.
Slipping and falling can trigger a variety of medical conditions including infections, depression, pneumonia, muscle weakness and/or muscle loss. As a result, the resident can suffer fractures and lifelong immobility that could have been prevented. The loss of range of movement could place the resident at increased risk for developing bedsores. Immobility can cause other significant issues including preventing the individual from taking a deep breath which could lead to pneumonia, bladder infections, lung infections, pressure sores and skin breakdown.

Forsyth Nursing Home Resident Safety Concerns
Both the state of Illinois and the federal government routinely update their nursing home databases concerning opened investigations, health hazards, safety concerns and filed complaints of facilities nationwide. They post the updated information on various websites including Medicare.gov. Currently, Hickory Point Christian Village maintains a four out of five available star rating compared to other facilities throughout the United States. This includes five out of five stars for staffing issues, four out of five stars for quality measures and three out of five stars for health concerns.
However, our Forsyth nursing home neglect attorneys have found numerous safety concerns involving this facility. One serious concern includes:
- Failure to Develop, Implement, and Enforce a Complete Care Plan to Ensure That All the Resident’s Needs Are Met with Appropriate Actions and Measurable Timetables
In a summary statement of deficiencies dated 03/19/2015, a notation was made by a state investigator during an annual licensure and certification survey concerning the facility's failure to "implement the Care Plan by failing to place a pressure sensitive alarm in the wheelchair [for a resident at the facility].” The state investigator first noted the facility’s failure by reviewing a resident’s March 2015 Electronic Order Summary Report.
The deficient practice by the nursing staff at Hickory Point Christian Village involved a review of the resident’s 12/04/2014 Care Plan calling for “intervention for [the resident to have a magnet alarm on [her] chair to alert staff when she is up without assistance.” The resident’s 5:21 PM February 15,2015 Nurse’s Notes documents that the resident “had a fall today around 1600 [4:00 PM].” At that time the resident “was toileting herself and lost balance and strength in her legs.” Nurses Notes documented later that evening at 9:54 PM that “since her [the resident] fall this evening,” the resident “complains of sharp shooting pain down her forearm.” The nurse notified the resident’s physician who “wants an x-ray done tomorrow [02/06/2015].” The radiology report documented that the resident suffered a radial fracture on her forearm.
The state investigator interviewed the facility’s Administrator at 1:05 PM on 03/17/2015 who stated that the resident “attempts to transfer herself and that [the resident’s] magnet alarm is to alert staff when [the resident] is up by herself.” The Administrator also confirmed that the resident’s “magnet alarm was not on her wheelchair at the time of her fall on 02/05/2015.”
