Unfortunately, abuse and neglect occurring in nursing facilities in the state of Illinois are not uncommon occurrences. However, the abuse that happens in nursing facilities is often difficult to define and hard to identify. In many incidences, the abuse goes unreported by the victim who lives in fear of retaliation or never identified by family members and friends who are unaware that the abuse is occurring. Sadly, the Gibson City elder abuse attorneys at Rosenfeld Injury Lawyers LLC have represented many residents who have been abused, neglected or mistreated by their caregivers.
Common warning signs that a nursing home abuse is occurring will often involve specific symptoms or indicators that include:
- Bedsores (pressure wounds; pressure sores; pressure ulcers; decubitus ulcers)
- A negative unexpected change in the resident’s behavior
- Emotional withdrawal
- Silence or visible signs of fear when around caretakers
- Unexplained bruises, wounds or sores
- Marks or bruises around the genital area
- Physical discomfort or signs of emotional trauma
- Unexplained or sudden appearance of diseases, viruses or infections

- Failure to Report and Investigate Any Act or Report of Abuse, Neglect or Mistreatment of Residents
In a summary statement of deficiencies dated 02/18/2016, a notation was made during an annual licensure and certification survey by a state investigator concerning the facility's failure to "immediately report an allegation of abuse.”
The investigation involved a review of the facility 10/20/2015 Final Abuse Investigation Report that noted that on 10/20/2015, was reported that [the resident] was speaking to her son on the phone and stated ‘They are rough with me’.” The state investigator also reviewed the investigative packet involving the abuse incident that included interviews with the resident’s son, the facility Administrator, a Licensed Practical Nurse at the facility in two certified nursing assistants. The investigative interviews were conducted the day following the alleged abuse.
The facility Administrator stated that the resident’s son “called and informed [the Administrator of the resident’s] concern being treated roughly.” The son had “received a call from [the resident] on 10/20/2015 stated that they were rough with the resident.” One of the certified nursing assistants witnessed the statement when the resident was speaking to the sun over the phone expressing that “the girls [the Certified Nursing Assistants] are rough.” When the Certified Nursing Assistant asked the resident what that meant, the resident declined to give any details.
- Failure to Develop Policies that Prevent Mistreatment, Neglect or Abuse of Residents
In a summary statement of deficiencies dated 02/18/2016, a notation was made by a state investigator during an annual licensure and certification survey concerning the facility's failure to "operationalize their abuse policy by failing to immediately report an allegation of abuse.”
