Many families recognize that their only option in dealing with an elderly, disabled or injured loved one is to place them in a nursing home. Unfortunately, many nursing home residents receive poor quality care while staying at their facility. In many incidences, poor care is due to uncertified or untrained staff members or when the home is understaffed. The Decatur nursing home abuse attorneys at Rosenfeld Injury Lawyers have handled many cases where residents have been victimized through abuse, neglect, mistreatment or financial exploitation.

- Failure to Provide a Resident Environment Free of Accidents and Hazards:
In a summary statement of deficiencies dated 04/27/2015, an incident report investigation was opened concerning the facility’s failure “to identify and assess [a resident] reviewed for history of tobacco use” and the failure “to maintain control of [the resident’s] smoking materials per the facility resident smoking guidelines.” The result shows that the resident had “unsupervised access to a lighter that resulted in a fire in [the resident’s] room.”
- Failure to Provide Care and Services for the Resident’s Highest Well-Being:
In a summary statement of deficiencies dated 07/08/2014 a complaint investigation was opened concerning the facility’s failure “to provide treatment and services to promote healing and prevent infection for post surgical wounds resulting in infection and requiring additional hospital treatment.” The investigation is in response to hospital discharge instructions that were dated 5/2/14 documenting that the resident’s dressing should be left “in place for one week and then changed to a dry dressing daily as needed.”
However, the 5/9/14 through 5/18/14 Administration Record “documents only one dressing change on 5/12/14. By 5/19/14, the resident presented “an extremely dirty dressing. It was soaked with purulent drainage.” The facility discharged the patient to home on 5/20/14, but was admitted to a hospital the following day due to a “right lateral ankle post surgical infection. A right lateral ankle incision and drainage and placement of a vac dressing was performed. [The resident] was discharged from the hospital on 5/23/14.”
