Many nursing home residents who suffer with mental disorders and degenerative brain conditions are often unaware of their surroundings and seek to elope or wander from the facility. To ensure their safety, every nursing home resident upon admission and during their stay must be evaluated to determine their existing condition and mental status. This is because mobile residents, if left unsupervised, can easily walk away from the facility especially if essential security measures are not maintained.
Our team of dedicated nursing home advocate lawyers offer their services to Illinois nursing home residents who safety and well-being are compromised due to a lack of supervision or adequate training. In addition, we publish current publicly available data involving major safety concerns, opened investigations and complaints filed by loved ones, family members, victims, state surveyors and investigators. This information is often used to make the best decisions of where to place a loved one who requires quality care during challenging times of their lives.

Nursing Facility Resident Safety Concerns
On a continuing basis, the federal government updates its star rating summary system to be used as a comparative tool when evaluating nursing facilities nationwide. It posts this information on their website www.Medicare.gov. Currently, Heartland of Champaign maintains an overall two out of five available stars rating compared to other facilities throughout the United States. This includes five out of five stars for quality measures, three out of five stars for staffing issues and one out of five stars for health inspections.
The nursing home neglect attorneys at Rosenfeld Injury Lawyers have found many filed complaints against the facility involving nursing home safety. Some of these include:
- Failure to Provide a Safe Residential Environment:
- Failure to Provide Additional Security for Exit Seekers (Wanderers/Elopers):
In a summary statement of deficiencies dated 10/23/2015, a filed complaint is opened against the facility for its failure “develop a comprehensive care plan to address the resident’s Identify Offender status. This applies to [a resident at the facility].” This file complaint is in response to findings that a “Social Services Assistant stated [that a resident] had a felony conviction and was incarcerated prior to coming to the facility.
[The Social Services Assistant] was unsure of [the resident’s] Identified Offender status. According to the resident’s criminal history analysis, the resident “is an Identified Offender with Mental Illness/Substance Abuse and a moderate risk, requiring closer supervision and more frequent observation than standard or routine for most residents in an open facility.” In addition, the undated care plan of the resident “does not contain focus, goals or interventions related to [the resident’s status]”.
In a summary statement of deficiencies dated 07/14/2015, a complaint investigation was opened against the facility for its failure “to implement increased security measures related to escalated exit seeking behaviors for one resident.” This is in response to the resident entering “a stairway and was found sitting at the base of the stairs with injuries (closed head injury; hematoma of frontal scalp). The facility door alarm system failed to alert staff that [the resident] had entered the stairway. This has the potential to affect at risk residents [at the facility.]. This failure resulted in An Immediate Jeopardy.”
