The periodic inspection and surveys carried on Illinois nursing homes by the Illinois Department of health and some private inspection organizations showed that patients admitted to this rehabilitation center received poor health assistance and were victims to neglect and in more severe cases, physical abuse. The Rosenfeld Injury Lawyers put its experienced nursing home attorneys on the case and a review of the findings of ProPublica—a private health surveyor—and found the following situations:

  • Failure to provide specialized diet as ordered by dietician:  “According to a dietitian recommendation sheet dated 9/21/2011, there was a recommendation for a high protein diet for R11. The reason listed for the diet change was low [MEDICATION NAME]. The reason listed for the added supplement was due to decrease intake and decrease appetite with an unplanned 7% weight loss within three months. On 11/21/2011 at 12:57pm, R11 did not receive a high protein diet. The main entree, beef stew with vegetables, was not served as planned. R11 received a portion of four ounces, instead of the planned eight ounces. On 11/22/201 at 12:45pm,R11 received for lunch chopped meat, a portion between two to three ounces, one single serving of vegetable, rice, bread, salt and pepper pack. The menu tray card listed the diet served as low cholesterol/ low fat, mechanical soft. The menu tray card did not reflect that was R11 receiving a
    high protein diet, no added salt diet.”
  • Failure to report abuse to the abuse coordinator in a timely manner: “Employees are required to report any occurrences of potential mistreatment they observe, hear about, or suspect to a supervisor or the administrator. During observations of the lunch meal in the second floor dining room on 12/1/10 at 12:20 PM, surveyor observed a male visitor yelling “shut up” several times at R12. Surveyor further observed that there were three staff members (E8 nurse and E4, E9 nurse aides) were present in the dining room assisting residents with their meals. No staff member attempted to intervene and assist R12. In addition, the verbal abuse incident was not reported to the abuse coordinator until 12/3/10. During an interview with E4 (nurse aide) on 12/1/10 at 1:00 PM, E4 stated that the visitor was R12’s husband. E4 did not state that the staff should have intervene for the residents safety. In addition, E4 stated on 12/3/10 at 9:00 AM, that R12’s husband often yells at her and that she (E4) had not yet reported the incident to the administrator or abuse coordinator.”
  • Failure to provide timely incontinent care: “When E4 removed R3’s wet pants surveyor observed R3 wearing a blue incontinent bedding pad inside a cloth diaper which were both heavy with urine, urine smell and already with brownish
    discoloration. E4 asked R3 to position on his left side, E4 then proceeded to wipe R3 with washcloth that was soaked in water mixed with Dermarite solution. E4 wiped R3 in the backside and right side only once bypassing R3’s front side and left side, no soaping and no rinsing was done. Upon interview, surveyor asked E4 and E7 how often do they have to check incontinent residents for incontinent care both responded “every 2 hours”. Care Plan review stated : Peri care after every involuntary episode to keep resident clean and dry; Change clothes/ linens/ pads and diapers promptly when wet.”
  • Failure to address catheter leakage: “On 12/02/10 at 9:45 am, bedside care is about to be rendered to R5, when E5 CNA lifted up R5’s blanket, surveyor observed that there was a folded white linen sitting on top of R5’s front side, wet with brown ring discoloration around the edge, dressing on R5’s suprapubic catheter soaking wet with brown discoloration. Surveyor interviewed E7 and E1 both stated that they are all aware that R5’s catheter is leaking. Care plan reviewed, Z4 (physician) ordered [MEDICATION NAME] LA cap 4 mg by mouth every night for bladder control. However no further care plan was address regarding catheter leakage until it was discussed during the daily status meeting with the facility staff.”
