Greenfields of Geneva Ratings & Violations

Greenfields of Geneva Nursing facilities are required to use a gait belt for any resident who requires assistance when moving, walking, bathing, lifting or transferring between the bed and wheelchair. The nursing staff is expected to properly use the gait belt in accordance with the direction of the Physical Therapist at the facility. Unfortunately, the Geneva elder abuse attorneys at Rosenfeld Injury Lawyers LLC have represented many nursing home residents who have suffered serious injury caused by the negligence of Certified Nursing Assistants, Registered Nurses and Licensed Practical Nurses at facilities throughout Illinois.

A gait belt or safety belt as an effective fall prevention device that is applied around the resident’s waist to assist the resident in balancing, walking and lifting. To use it effectively, the Certified Nursing Assistant is required to firmly grasp the back of the gait belt while walking slightly behind or alongside the resident. However, many Certified Nursing Assistants lack proper training to use the device properly, resulting in catastrophic injuries if the resident falls.

Geneva Nursing Home Resident Safety Concerns

The federal government and state of Illinois routinely update their databases to reflect the most current information on opened investigations, filed complaints, safety concerns and health violations of nursing homes throughout the United States. The updated information is posted online on numerous sites including, through a comparative analysis tool used by families in search of finding the best location to place a loved one in a nursing facility providing the highest level of care.

Currently, Greenfields of Geneva maintains an overall four out of five available stars compared with other facilities nationwide. This includes four out of five stars for quality measures, staffing issues, and health concerns. However, our Geneva nursing home neglect attorneys have found numerous filed complaints and safety concerns. One of these concerns include:

  • Failure to Provide Every Resident a Nursing Home Environment Free of Accident Hazards and Risks and Provide Adequate Supervision to Prevent an Avoidable Accident Causing Actual Harm

In a summary statement of deficiencies dated 06/18/2015, a complaint investigation against the facility was opened for its failure to "follow physical therapy instructions for transferring and assisting residents to use the bathroom.” In addition, the state investigator also noted the facility’s failure “to follow their policy for transferring residents.” It was noted that the failure resulted in the resident “sustaining a cervical fracture and being hospitalized.”

The incident was first noted after a falling incident occurred at the facility where the resident was discharged to a local hospital. The state investigator reviewed the resident’s MDS (Minimum Data Set) that revealed the resident “was not steady, only able to stabilize with staff assistance for moving from seated to standing positions, walking, turning around and moving on and off the toilet and surface to surface transfer.” The resident’s Fall Risk Assessment showed that the resident scored an 11 indicating the resident “was a high fall risk with a score of 10 or above.”

On the date of the incident, a Certified Nursing Assistant transferred the resident “to the bathroom with a walker [… by bringing] a wheelchair in to transfer [the resident] to the bathroom but [the resident] said she could walk with a walker.” The Certified Nursing Assistant said that “she did not place a gait belt on [the resident] during the transfer [...and] said she walked with the resident to the bathroom and let go of [the resident] to adjust the toilet seat.” The CNA said that “when I let go of her, she fell… on her buttocks and then fell backward and hit her head on the wheel of the wheelchair.”

The state investigator noted that the action of the Certified Nursing Assistant failed to follow the facility’s policies and procedures titled Safe Resident Handling that reads in part: “Gait belt usage is mandatory for all resident assists with the exception of bed mobility and/or medical contraindications.”

Client Reviews
Jonathan Rosenfeld was professionally objective, timely, and knowledgeable. Also, his advice was extremely effective regarding my case. In addition, Jonathan was understanding and patient pertaining to any of my questions or concerns. I was very happy with the end result and I highly recommend Jonathan Rosenfeld. Michonne Proulx
Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own. Ethan Armstrong
This lawyer really helped me get compensation for my motorcycle accident case. I know there is no way that I could have gotten anywhere near the amount that Mr. Rosenfeld was able to get to settle my case. Thank you. Daniel Kaim
Jonathan helped my family heal and get compensation after our child was suffered a life threatening injury at daycare. He was sympathetic and in constant contact with us letting us know all he knew every step of the way. We were so blessed to find Jonathan! Giulia
Jonathan did a great job helping my family navigate through a lengthy lawsuit involving my grandmother's death in a nursing home. Through every step of the case, Jonathan kept my family informed of the progression of the case. Although our case eventually settled at a mediation, I really was impressed at how well prepared Jonathan was to take the case to trial. Lisa
