Concerning Findings Regarding Patient Care at Fairmont Care Centre

A survey conducted by the State Department of Health and diverse private health inspection firms un-earthed some episodes of poor patient supervision and inadequate patient transportation which led to the patient falling. The survey conducted by ProPublica—a private inspection firm—was reviewed by our nursing home attorneys in Rosenfeld Injury Lawyers and episodes of poor supervision which could be construed as nursing home negligence were found:

  • Failure to assess and provide prompt intervention for a resident with critically low oxygen saturation:  “On 8/11/10 during medication pass observation from 8:45 am to 9:15 E13 provided no intervention for a critically low oxygen saturation level of 84 %-86%. It is only after surveyor prompting vital signs are rechecked for R17. E13 tells surveyor R17 is supposed to be at oxygen saturation level of 96% but with consistently low readings increases the oxygen by 1 liter. E13 only assessment of R17 consists of asking the resident how he feels at when she entered the room and at approximately 9:45 am. E13 does call physician and increases oxygen to 4 liters. Oxygen saturation on 4 liters is 89%. Physician then gives order to send R17 to hospital. Nurses notes of 8/11/10 at 6:30 pm document R17 was admitted to the hospital with [DIAGNOSES REDACTED]. This delay and lack of serious consideration/assessment/intervention by E13 of R17 condition has potential for further debilitating complications for R17.”
  • Failure to give specialized rehabilitative care per the patient’s assessment or plan of care: “On 8/12/10 at 10:15 am E3 (Social Service Director/Psychosocial Rehabilitation Director) stated, “There are no psychosocial groups….stopped in January, 2010.” (R9) initially came in with medical issues she stabilized in January and was [DIAGNOSES REDACTED].” Facility has no PASSRR assessment to determine type of specialized rehabilitation services (R9) will need.  R9 receives psychotherapy service 1:1 on a weekly basis. Review of these progress note [REDACTED].” There are no measurable objectives presented for these areas in the psychotherapy notes or in the care plan. R9 major needs are not prioritized in her Individual treatment plan. Care plan presented for psychosocial needs is not signed by the interdisciplinary team. No lesson plans exist for any skills training and there is no supportive documentation any skills training related to money knowledge, management, laundry and shopping, conflict avoidance has been offered to (R9). No policies for psychiatric rehabilitation program were presented for review.”
  • Failure to investigate multiple falls and implement interventions to prevent falls: “On 10/12/2011 at 11:12 am, R5 was in the room. R5 was laying on the bed at the time. R5 inquired from the surveyor was the door shut. R5 was told the room door was shut. R5 commented the door was to be opened. R5 sit up on the side of the bed. No personal or pressure activated alarms were present and sounding at the time. No floor mats were present on either side of the bed. No staff member was present in the room, and R5 was not visible from the hallway with the door closed. On 10/12/2011 at 11:35 am, R5 was ambulating to the unit’s dining room with a walker. On 10/13/2011 between 2:45pm and 3:10pm, E7 (restorative nurse) and E8 (assistant restorative nurse), reported R5’s restorative nursing program was intensified and the pharmacist reviewed R5’s medications. E7 did not report what the cause of R5’s fall, after the pharmacy review, nor any other investigation completed to determine the cause of R5’s multiple falls.”
  • Failure to use proper techniques when transferring a resident: “According to R22’s initial minimum (MDS) data set [DATE], R22 needs physical assistance by two person, for transferring. On 9/27/2011 at 10:05 am, R22 lost balance while being supported by a restorative aide. Both resident and restorative aide landed on the floor. R22 sustained posterior thigh abrasion. R22’s care plan effective 9/28/2011 stated re-in-service/re-educate restorative aide on [DIAGNOSIS REDACTED] transfer technique. On 9/10/2011 at 9:15 am, CNA (certified nurse aide) was transferring the resident from bed to wheelchair but resident lost balance while standing up. R22 hit his back against the wheel chair and foot rest. He sustained small multiple skin abrasions.”
