Critical Discoveries Regarding Patient Care at Dolton Nursing & Rehabilitation

According to data from nursing home surveys conducted by the Illinois Department of Health other private survey agencies, there have been numerous episodes of poor patient care and verbal abuse at Dolton Nursing & Rehabilitation which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to protect residents from abuse: “On 8/18/10 at 1:45pm via telephone Z1 (power of attorney for R1), said that on 7/5/10 R1 was in the dining room and needed to use the bathroom. Z1 said that he inquired which certified nurse aide was providing care for R1. Z1 said that he was told E4 (certified nurses aide), was responsible for caring for R1, and that she was on break. Z1 said they waited about 10 minutes and E4 came and told Z1/R1 that she was on break and would there in a minute. Z1 said that they waited another 10 minutes, and E4 did not come. Z1 said that he took R1 back to the room so she would be close to the washroom when E4 arrived. Z1 said that when E4 arrived to the room to provide care for R1, E4 was very irate. Z1 said that E4 took R1 to the washroom and after about 1 or 2 minutes he heard E4 hollering at R1. Z1 said that E4 was yelling out at R1 about “you made me cut my break short to take you the washroom, and you don’t have to use it.” Z1 said that he had to intervene because he said that he felt that E4 was [MEDICATION NAME] R1, and that R1 could not defend herself. Z1 said that he told E4 not to holler or yell at his wife. Z1 said that E4 was out of control and staff tried to intervene but E4 kept yelling. Z1 said that E4 was verbally abusive to R1 and was hollering and screaming at him. Z1 said that E4 was as abusive to the nursing staff as she was to R1/Z1. On 8/11/10 during the daily status meeting E2 said that she was aware of the incident of involving E4. E2 said that on 7/4/10 E4 texted her phone about the incident that occurred between E4 and R1/Z1. E2 said that E5/E6 did mention the incident on Monday 7/5/10. E2 said that she did not investigate the incident as verbal abuse, but thought it was a personality conflict. E2 said she did not talk to Z1 regarding the incident reported to her from E5/E6.”
  • Failure to properly manage residents’ money: “On 5/08/2012, R19 and R20’s current trust fund accounts were found to have amounts greater than $1800. R19’s fund is $1,891.77, and R20’s fund has $1,994.67. The facility also lacked documentation that either the residents or guardians were notified of the amounts when they went over $1800.00 dollars. On 5/08/2012, E7 (bookkeeper) stated, “I didn’t know I should notify anyone about those amounts.”During an interview on 5/10/12, E1 (administrator) stated, “I didn’t know of the limits on Medicaid account balances.”
  • Failure to report abnormal lab results to a physician in a timely manner: “On 3-31-10, R5 repeated labs were also abnormally high, BUN 39, Creatinine 2.05, and K- 5.4. Again no new orders were indicated. A high (Potassium) can put R5 at risk for irregular heart rhythm and kidney failure. An abnormal high BUN and Creatinine puts R5 at a high risk for [MEDICAL CONDITION] or dehydration.On 4-2-10 the labs were repeated again and were higher. BUN 39, Creatinine, 2.15 and the K- 5.2. The doctor wrote again after receiving the report to repeat the labs on 4-6-10. No other intervention was noted. All elevated labs are indicative of dehydration. There is no evidence that R5 was being monitored by staff for dehydration or heart palpitations. There are no records that R5 was given fluids or the amount of fluids pushed per doctor order.There are no indications that R5 was assessed for risk of abnormal lab values.”
  • Failure to ensure call lights are accessible to residents: “On 5/8/12 at 10:40am during visit to R9’s room. R9 and R1 were observed sitting up in their recliners. R9 was able to shake hands using her left hand. R9’s call light was noted to be on the bed but well out of reach of R9. R1’s call light was hanging on the wall with R1’s back to the wall. An interview with E8 (LPN) stated, “R1 is only up for 2 hours and R9 is only up for 1 hour and they can’t use the call light anyway.” At approximately 12:00pm, surveyor returned to R9’s room to see R9, the call light for R9 was still on the bed and out of reach. During this this time the call light for R1 was also, still hanging on the wall behind R1 and out of reach.”
