Consent to Settle Letter
Please be advised that the Insurance Co., the insurer for the tortfeasor/defendant in this matter, has extended a full policy offer in settlement of the personal injury claim by my client arising out of the automobile accident that is the subject of the present underinsured motorist claim. Enclosed is a copy of the letter from the insurer setting forth the settlement offer, together with a copy of the coverage selection page showing liability limits in the amount of the settlement offer.
Pursuant to the terms of the applicable insurance policy, notice is hereby given that my client intends to enter into a settlement of his claim with the tortfeasor as set forth above, and requests your company's written consent to this settlement. Pursuant to the language of the underinsured motorist coverage provisions of the applicable policy, your company's consent to this settlement cannot unreasonably be withheld.
In accordance with the notice that was previously sent to your company, my client will now pursue his claim pursuant to the underinsured motorist coverage provisions of the applicable policy. I will shortly be forwarding you a settlement demand with respect to this claim.
