Concerning Findings Regarding Patient Care At Church Creek

According to data from nursing home surveys conducted by the Illinois Department of Health and other agencies, there have been numerous episodes of poor patient care at Church Creek which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Insufficient treatment to prevent bedsores “June 27, 2011 (R8) was admitted to the facility. On July 7, 2011, (R8) developed a [MEDICAL CONDITION] pressure ulcer to his mid spine. On August 5, 2011 the pressure ulcer to the spine increased to a [MEDICAL CONDITION] measuring 3.5 x 2.5 x 0.1 centimeters.”
  • Failure to ensure each resident’s drug regimen is free from unnecessary drugs: “Z1(Consultant Pharmacist) documented in pharmacy review report dated July 1, 2011 through July 15, 2011, “REPEATED RECOMMENDATION from 5/11/2011…”, “Please re-evaluate continued use of [MEDICATION NAME] ([MEDICATION NAME]). Rationale for Recommendation – Concurrent use of antipsychotics and [MEDICATION NAME] is listed as CONTRAINDICATED in [MEDICATION NAME]’s product labeling due to an increased risk for developing extrapyramidal reactions (EPS) secondary to [MEDICATION NAME] receptor antagonism. If this therapy is to continue, it is recommended that a) the prescribed document an assessment of risk versus benefit, indicating it continues to be a valid therapeutic intervention. Z2 (physician for R2) responds in writing to pharmacy recommendation by declining recommendation. Under “Rationale,” for physician response, no explanation was given. “
  • Failure to accommodate needs and preferences of patients: “On 8/17/11 at 11:10 AM, R6 was in bed with electrical stimulation machine for lower back pain. R6 lips were dry and stated that she was thirsty. R6 also complained of lower back pain upon movement. The glass of water was on top of the over-bed table which was 2 feet away from the bed. The water pitcher was on top of the dresser which was 3 feet away from the bed. R6 said, the pitcher is not always filled with fresh water. R6 requested the surveyor to move the table so she can reach the glass. On 8/18/11 at 11:30 AM, R6 was in bed in slight to moderate lower back pain. The water pitcher was on top of the over-bed table across the room which was by the roommate’s bed and out of reach.”
  • Failure to develop comprehensive care plans for all patients: “August 16, 2011 at 2:25 p.m. during an observation of wound treatment for [DIAGNOSES REDACTED]. August 17, 2011 at 10:00 a.m. and August 18, 2011 at 1:00 p.m. during record review of (R1, R3, R7 and R8) there were no care plans to address the resident’s pressure ulcers August 17, 2011 at 10:20 a.m. during an interview with (E1) Administrator and (E2) Director of Nursing (DON); the facility was not able to provide writer with the care plans that address the pressure ulcers/sores for (R1, R3, R7 and R8).”
