Crashing into fully loaded semi-tractor-trailers can leave drivers and passengers with horrific injuries. Commercial vehicles’ sheer weight and size, like Swift Transportation trucks, often result in catastrophic accidents when the truck driver or other motorists violate traffic laws.

Many of these cases involve safety violations where the Swift trucking accidents could have been prevented if the truck drivers had not made an unexpected lane change, rear-ended passenger vehicles, or failed to see other vehicles in their blind spots.

Swift Trucks

Carl and Betty Moyes founded B & C Truck Leasing in Plain City, Utah, in the 1950s, which would eventually become Phoenix, Arizona-based Common Market and finally Swift Transportation Company.

The family purchased the Swift’s trucking assets from the Swift Meat Packing Co. in the mid-1980s.

By 1990, the Swift Trucking Company became one of the largest trucking companies in the United States, operating a fleet of more than 800 semi-tractor-trailers, and became a publicly traded entity (SWFT) [1] on NASDAQ. The following year, Swift, a big company, purchased Arthur H Fulton, Inc. Trucking.

In 2018, Swift Transportation Company generated gross annual revenue of $3,344,000,000. As of 2022, 15,000 Swift Transportation truck drivers are operating a fleet of over 15,902 trucks crisscrossing North America on the major interstate system.

Swift Transportation Safety Record and Statistics

The Federal Motor Carrier Safety Administration (FMCSA) releases statistics each year to assist trucking companies in identifying improvement areas for truck safety. In December 2022, the last two years’ accident statistics of Swift Trucking were released –

  • Number of total accidents – 1,069
  • Number of fatal crashes – 31
  • Number of injury crashes – 299
  • Number of driver fitness violations – 128
  • Number of unsafe driving violations – 1,837
  • Number of vehicle maintenance violations – 6,232
  • Number of hours of service violations – 1,384
  • Number of total inspections – 20,170
  • Vehicle inspections: 11,793 – conducted by the Federal Motor Carrier Safety Administration (FMCSA) [2]
  • Driver inspections: 19,951 – conducted by the Federal Motor Carrier Safety Administration (FMCSA)
  • Due to these inspections, Crete Carriers had 16.9% of its vehicles deemed out of service (national average – 21.4%) and 1.4.% of its drivers taken out of service (national average – 6.0%)

Swift Transportation Accidents Involving Injuries and Fatalities

Trucking accidents are typically more catastrophic than crashes involving only passenger cars due to the commercial vehicle’s weight and size. While passenger cars usually weigh approximately 4,000 pounds, a semi-tractor trailer can weigh upwards of 80,000 pounds or more.

The number of truck accident cases nationwide has risen significantly in recent years due to inexperienced drivers. Swift and other companies are challenged in keeping experienced drivers in this same period, the average age of drivers recently out of driver training school has lowered significantly.

Swift Trucking Accident Examples

The results of a trucking accident are often devastating, leaving victims seriously injured in the accident suffering terrible injuries or wrongful death. A small sampling of Swift Trucking accidents includes –

  • Fatal Crash on October 25, 2019 – The San Bernardino City Police Department reported a deadly two-vehicle collision on W. 5th St just west of Garner Street in San Bernardino, California.
The crash involved a Swiss Transportation semi-truck and another vehicle at night on a dry road surface that ended with three fatalities.
  • Fatal Collision on September 20, 2019 – The Utah Highway Patrol reported a deadly two-vehicle collision, including a Swift Transportation trailer (bobtail) flatbed on Interstate 15 in Elwood, Utah. The crash occurred in bad weather on a rainy night, resulting in one injury and one fatality.
  • Accident on November 5, 2019 – The Downey City Police Department reported a two-vehicle collision occurring on Paramount Blvd. in Downey, CA. The report indicates that a Swift Transportation vehicle (semi-truck) collided with another motor vehicle during daylight hours. The harm caused in the crash was an injury.
  • Collision on December 17, 2019 – Local law enforcement reported a two-vehicle crash with a semi-truck owned and operated by Swift Transportation on Route 460 in Virginia. The accident resulted in an injury.
  • Crash on November 28, 2019 – The Oregon State Police reported a single vehicle after the Swift Transportation semi-tractor trailer ran off the road and rolled over after crossing the center median. One person was seriously injured.
  • Fatal Accident on February 10, 2019 – The Texas Department of Public Safety [3] reported a deadly nighttime two-vehicle collision in Texas. The accident occurred on an undivided two-way road involving a Swift Transportation semi-truck that ended with two injuries and a fatality.

Trucking companies, including Swift transportation, must provide all existing and new drivers with proper training and supervision to avoid an accident with property damage, injuries, or fatality.

Common Causes of A Trucking Accident

The National Highway Traffic Safety Administration (NHTSA) statistics reveal that accidents involving large commercial vehicles in America involve:

  • Improper Truck Maneuvering Many commercial vehicle accidents result from the trucker traveling too fast, changing lanes too quickly, or turning too sharply based on the current road conditions.
  • Distracted Driving – Any distraction, such as speaking on a smartphone or sending text messages, is prohibited by law and creates a dangerous scenario for everyone sharing the roadway.
  • Vehicle Malfunction – All motor carriers and commercial truckers must maintain their vehicles. When they don’t, catastrophic accidents happen, leaving the company legally liable for damage, loss of life, or severe harm.
  • Driving Under the Influence – Swift drivers operating a motor vehicle after consuming too much alcohol or taking illegal drugs can create a dangerous situation for everyone sharing the roadway.
  • Failing to Follow Traffic Rules – All commercial carriers and truckers must follow their company policies and Federal Motor Carrier Safety Administration (FMCSA) regulations.
  • Aggressive Behavior – Any driver operating their vehicle aggressively could cause severe harm or wrongful death of an innocent passenger or another motorist.
  • Drowsy Driving – The demands of short-haul and long-haul tractor-trailer drivers often require operating their vehicle for many hours without taking a break, leading to driver fatigue.

The semi-truck driver often causes truck accidents due to erratic movements or because they are distracted or fatigued. In these car accident cases, attorneys working on behalf of their clients can obtain full and fair compensation from trucking companies.

But, this rests on their proof to the claim’s adjuster or jury that the Swift transportation drivers and company were cited for safety violations or had an extensive citation record.

Financial Recovery for A Personal Injury Or Wrongful Death-Related To Truck Accidents

Every victim injured in a truck accident by a Swift Transportation truck driver in a commercial van or truck has the legal right to file a lawsuit or claim seeking financial damages from every party at fault.

However, the victim must follow Illinois tort laws to build and present a compensation case within the legal deadline. Often, the process is complicated and requires the services of an experienced truck accident lawyer.

The truck accident lawyer will file a lawsuit and litigate the case in court on behalf of the injured party. Alternatively, the accident lawyer can negotiate with the insurance company directly to ensure that all responsible parties pay for damages.

Filing a truck accident claim against Swift, their drivers, and other multiple parties is the first legal remedy available to injured victims.

Their truck cases offer the fair settlement they deserve for their damages, from the first ambulance ride to seeking medical care to recovery, including:

  • Emergency medical care
  • Ongoing medical expenses and hospital costs
  • Future medical bills
  • Lost wages
  • Loss of work-related benefits
  • Lost income – future – due to a permanent or temporary disability
  • Rental car costs while your car is under repair
  • The cost of a vehicle replacement
  • Psychological suffering – mental anguish or emotional trauma
  • Pain and suffering

Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own.

- Ethan Armstrong
