He came in on Monday, Tuesday and Sunday of this week.” The Social Services Director indicated that the resident “did not mention sex during questioning [but] just mentioned a male coming into the room and spending a great deal of time the first few times and a short time on Sunday.” The resident voiced that the unwanted visitor was a “male nurse.”

    The state investigator interviewed the Director of Nursing who stated “there was one accusation that a male nurse had sex with the resident. We did have a male nurse (Registered Nurse), but we let him go a few months ago for medication errors during his probationary period.”

  • Failure to Ensure Residents Remain Free from AbuseIn a summary statement of deficiencies dated 09/22/2016, a notation was made by a state investigator involving the nursing home’s failure to “prevent one resident… from being physically and verbally abused.” The deficient practice was first noted in the state investigator’s findings was first documented by a Certified Nursing Assistant (CNA) on 09/02/2016 with notations in the Facility Occurrence Resolution Notes.”The CNA “reported to the nurse that they “had witnessed [another Certified Nursing Assistant holding the resident’s] wrists down during care and holding her hand over [the resident’s] mouth.” The CNA also said that they had witnessed the other Certified Nursing Assistant holding “a soiled brief up to [the resident’s] face and was yelling at [the resident who is] cognitively impaired and has frequent behavioral issues such as hitting and yelling.” The document revealed that the resident stated ‘she put sh*t in my mouth’. The documentation revealed that “there were no signs of the resident having feces in his mouth.”

    The alleged CNA perpetrator “admitted holding her hand across his mouth and holding his wrists down.” The CNA “was immediately terminated from her position with the facility and a police report was made by the Administrator. The facility’s Director of Nursing stated on the morning of 09/22/2016 that “she was told of the incident and other department heads waited for [the perpetrator] to come back from a break.” At that time, the Director of Nursing interviewed the CNA who admitted to the allegations.”
