- Failure to Investigate a Report Allegations or Incidents Involving Abuse and Neglect In a summary statement of deficiencies dated 02/19/2016, a state investigator noted when performing an annual licensure and certification survey that the facility failed to “investigate and report an allegation of abuse.” The deficient practice was first noted in the state investigator’s findings after reviewing a completed Abuse Investigation Questionnaire documented by the facility Administrator on 11/05/2015 and a housekeeper interviewed “as part of an abuse allegation investigation involving a resident no longer at the facility.”The incident involved a Licensed Practical Nurse that a resident claimed was “kind of rough with talk, jerk shirt, and pull arm.” The facility Administrator verified on the morning of 02/17/2016 that the questionnaire was completed and that the housekeeper informed the Administrator that they “had witnessed [the resident] walking into the nurse’s station, and [a Licensed Practical Nurse was] telling the resident that the resident should not be in that area and [the resident] kept repeatedly asking ‘Why?’” The housekeeper stated that the Licensed Practical Nurse “spoke loudly and close to [the resident’s] face and said ‘because it’s the damn nurse’s station.”The state investigator interviewed the facility Director of Nursing on the morning of 02/18/2016 with the Administrator. Both stated that “they did not consider [comments by the Licensed Practical Nurse] as an abuse allegation because it was made while they were investigating another incident and confirmed that they did not report it to the Illinois Department of Public Health” as required by law.
The Director stated that they “did not believe [the LPN] would willfully hurt anyone.” When the investigator asked if the Licensed Practical Nurse “was interviewed about the alleged incident with [the resident, the Director] stated she believed she did and would locate the interview.” However, no documentation on the interview could be found.
- Failure to Develop, Implement or Enforce Abuse Policies In a summary statement of deficiencies dated 02/19/2016, the state investigator noted the facility’s failure to “implement its Abuse Prevention Program Policy for investigating reporting allegations of abuse.”The investigator confirmed that the allegations of abuse above were not reported to the Illinois Department of Public Health until nearly 3.5 months after an allegation of abuse involving a resident was first documented. The state investigator noted that the actions by the administrator and management at the facility failed to follow their revised 11/11/2011 Abuse Prevention Program Facility Policy that reads in part:“Once the Administrator… Receives an allegation of mistreatment of neglect or abuse, including injuries of unknown source…; The administrator will appoint a person to take charge of the investigation.”
“The facility must ensure that all alleged violations involving mistreatment, neglect or abuse, including injuries of unknown source… and reasonable suspicion of a crime are reported immediately to the Administrator the facility and other officials in accordance with the State Law through established procedures.”
