- Failure to Notify a Resident’s Physician of a Change in Their Condition Including a Decline in Their Health or Injury In a summary statement of deficiencies dated 06/28/2016, an Illinois state surveyor performed an annual licensure and certification survey, noting the facility’s failure to “timely notify the physician of weight loss, the growth in the mouth.”The failure involved a moderately cognitively impaired resident whose 06/11/2016 Nurse’s Notes revealed that a Registered Nurse first “noticed a large irregular quarter shaped growth in the roof the resident’s mouth that is red in appearance. Does not appear to have drainage. The family is aware, does not feel resident needs to go to the emergency room but does want the medical doctor notified on Monday. Will continue to monitor.”The facility’s Assistant Director of Nursing asked the resident on the afternoon of 06/24/2016 to open their mouth and noticed “a large beet red colored mass on the roof of her mouth measuring approximately 9.0 millimeters by 5.0 millimeters with two humps inside her mouth.” The resident “stated pills / medicine sometimes bothers her and get stuck on the roof or mouth but she is not in any pain at the moment.”
The resident’s 06/13/2016 (Monday) Nurse’s Notes at 10:27 AM documented by Licensed Practical Nurse (LPN) revealed that the nurse had “left a message for the physician.”
On 06/23/2016 at 8:30 AM, the facility Director of Nursing stated “I called and left a message at [the resident’s] doctor’s office. No, I did not talk with the doctor. The doctor’s office never called me back during my shift.” The following day at 2:23 PM the LPN stated that they had told the Director of Nursing regarding the sore in the resident’s mouth and believed that the director had “notify the physician.”
An interview was conducted with the resident’s physician at 1:14 AM on 06/23/2016 who stated “she had not seen [the resident] for over a year […and] stated she has asked the facility for [the resident] to be seen by another doctor multiple times because [the resident] has not been seen in her office for quite some time.” The doctor stated “she was not aware of any weight loss or mass in [the resident’s] mouth […and] stated she had not been contacted for either of these issues.”
The state investigator noted that the actions of the Director and nursing staff at the facility failed to follow their February 2013 Change of Condition Reporting Form that reads in part:
“The facility will notify the resident’s physician and the resident’s representative whenever there is a significant change in the resident’s health, mental, or psychosocial status. … Notify the physician of a change in condition/incident/accident/unusual occurrence and assess findings.”
