  • Failure to Ensure Residents Remain Free from Abuse/Involuntary Seclusion In a summary statement of deficiencies dated 04/26/2016, a notation was made by a state investigator during an annual licensure and certification survey concerning the facility’s failure to “ensure that residents are free from abuse.” The deficient practice by the nursing staff involved one resident “reviewed for staff abuse.” It was noted that “this abuse resulted in [the resident] being kicked and sustaining a leg wound and being frightened.”The investigator’s findings involved a review of the resident’s 10/03/2015 MDS (Minimum Data Set) showing that the resident’s “cognition to be intact”. The resident’s MDS (Minimum Data Set) revealed the resident “requires the extensive assist of two staff for toileting and transfers.”

    As part of the investigation, a review of the resident’s 01/14/2016 Incident/Accident Report documented by a facility Registered Nurse revealed that the nurse “heard the resident yelling, entered her room and resident alleged [a Certified Nursing Assistant (CNA)] kicked her on her legs. Observed hematomas on bilateral lower extremities and skin tear on lower shin.” It was reported that the Certified Nursing Assistant “was sent home immediately and the physician and family member Power of Attorney (POA) over healthcare were notified.”

    A part of the 01/20/2015 Final Incident Report documents that the 98-year-old female resident is “able to make her needs known.” The report states that “she was sitting on the toilet and the CNA told her to get up off the toilet and [the resident] told the CNA she needed help.” The resident stated: “the CNA was putting her hands up in her face and that she turned her head to avoid being hit.” It was also documented that the resident told the Registered Nurse that the CNA “kicked both of her legs […and] put her roughly in the wheelchair.”

    The facility’s Administrator stated on 04/22/2016 that the resident “was really shaken up after the incident, and wouldn’t come out of her room, would eat, wouldn’t talk to anyone, put herself into a shell, and still to this day, talks about it.”

  • Failure to Investigate and Report an Allegation of Abuse In a summary statement of deficiencies dated 04/26/2016, the state investigator noted the facility’s failure “to notify local law enforcement of the suspicion of a crime.” The failure noted by the state investigator involved the incident of abuse detailed above. While the Administrator confirmed that the Certified Nursing Assistant “was terminated due to [the resident’s] injuries being consistent with her allegations of being kicked, [the Administrator stated that it was the resident’s daughter, who] “actually called the police later.”It was noted that on 04/26/2016, the Administrator “provided a police report on 01/14/2016. The intake report dated 02/05/2016 [notes that] the person reporting the battery was [the resident’s] daughter.”
