The Sordid findings Regarding Patient Care at Niles Nursing & Rehab Center
The periodic inspection and surveys carried on Illinois nursing homes by the Illinois Department of health and some private inspection organizations showed that patients admitted to this rehabilitation center received poor health assistance and were victims to neglect and in more severe cases, physical abuse. The Rosenfeld Injury Lawyers LLC put its experienced nursing home attorneys on the case and a review of the findings of ProPublica—a private health surveyor—and found the following situations:
- Failure to investigate possible mistreatment of residents: “R30 had a choking incident while being fed by staff during a meal. R30’s closed record review on 10/13/11 reveals nursing notes dated 8/8/11 at 5:45pm stating R30 turned blue during evening meal, was sent to hospital and admitted with a [DIAGNOSES REDACTED]. On 10/14/11 at approximately 10:30am, E2 told survey team that an incident report and investigation were not completed and the facility did not feel the incident needed to be reported to the State Agency because it was a ‘medical emergency.’ Review of R30’s hospital record for this incident shows R30 expired in the hospital 30 hours after choking during the consumption of the evening meal.” Click here for more information regarding choking cases involving nursing home patients.
- Failure to properly prevent and treat pressure sores: “R3’s February 2011 Treatment Administration Record (TAR) showed that on 2/4/11, the Silvadene to R3’s sacrum was discontinued, and it was marked ” healed.” Review of R3’s Physician Order Sheet (POS) indicated that on 4/10/11, a Silvadene Cream was again ordered for R3’s coccyx area daily. However, there was no Silvadene treatment for [DIAGNOSES REDACTED] in nurses notes. In R3’s May and June 2011 TARs, there also was no mention of this sore. Z1’s Physician Wound Care notes dated 7/12/11 indicated that a 10 x 5.5 x 0.1 cm Stage II sore was found on R3’s sacrum with 100 % granulation tissue. There was no explanation why a sore this size was found only on 7/12/11 or why it has not progress from a smaller wound first. Z1’s recommendation of [MEDICATION NAME] was signed as applied in R3’s TAR from 7/12/11 until 7/31/11. However, R3 also has another July 2011 TAR which shows that R3’s sacral sore is receiving Silvadene cream daily starting July 8 until the end of July. This TAR also has blanks indicating no nurse signed it as treatment given on the following dates: 7/13, 7/14, 7/15, 7/24, 7/25, 7/26 and 7/28/11. Per R3’s Wound Care Notes, R3’s sacral sore became a stage IV by 8/13/11. On 8/13/11, R3’s Stage IV sacrum was measured at center: 3 x 2.2 x 2 cm and periwound: 15 x 10 x 0.1 cm with 100 % eschar /necrosis. As of 10/11/11, R3’s sacral sore was 4.5 x 5.2 x 2.2 cm with undermining of 3 cm at 12 o clock. The wound was described in this 10/11/11 Wound care Notes as with 100 % eschar/necrosis, is larger and is now foul- smelling. It was during this visit that Z1 recommended hospitalization for surgical debridement.”
- Failure to place call lights within reach of residents: “During the initial tour of the facility on 10/11/11 at approximately 9:15am with E21, R8 was observed sitting in her room in a wheel chair. R9 told surveyor that she is not able to toilet herself and requires staff assistance. R8 went on to say that when she needs assistance she uses the call light to get help. E21 told surveyor that R8 has a history of falls and is on fall risk precautions. R8’s call light was not within her reach.”
