Brookdale Burr Ridge Nursing facilities are legally bound to ensure that every resident remains safe throughout the facility at all times from abuse, mistreatment or neglect. Any abuse, or allegation of abuse, must be reported to the appropriate agencies including the Illinois Department of Public Health (IDPH) and law enforcement officers within 24 hours after the completion of the investigation. Unfortunately, the Burr Ridge elder abuse attorneys at Rosenfeld Injury Lawyers LLC have handled many cases where the nursing facility failed to investigate an allegation of abuse that led to additional harm of the resident.

Burr Ridge Nursing Home Resident Safety Concerns

Throughout the year, nursing home regulatory agencies for the state of Illinois and the federal government routinely update their nursing home databases to reflect the most recently opened investigations, filed complaints, health violations and safety concerns of every facility in the United States. The updated information is then posted on various sites including Medicare.gov. Many families use this information to choose the best location for the loved one who requires the highest level of skilled nursing care and hygiene assistance.

Currently, Brookdale Burr Ridge maintains an overall four out of five available star rating in comparison with other facilities nationwide. This includes 4 to 5 stars for quality measures and health concerns. However, our Burr Ridge nursing home neglect attorneys have found numerous safety concerns involving this facility that include:

  • Failure to Develop, Implement and Enforce Policies to Prevent Abuse, Mistreatment or Neglect of ResidentsIn a summary statement of deficiencies dated 06/12/2015, a notation was made by a state investigator during an annual licensure and certification survey concerning the facility’s failure to “follow the policy for reporting and investigating abuse allegations.” The deficient practice by the nursing staff of Brookdale Burr Ridge affected three residents at the facility. The failure was first noted at 9:00 AM on 06/10/2015 on a review of the Resident Council Minutes that revealed comments made from to residents where one resident “was noted to state: that nursing is terrible, they don’t help him and they are slow.” The other resident was “noted to complain in the meeting that about the medical is squeezing her and staff laughing at her.”

A member of the Activities staff stated 11:15 AM on 06/10/2015, she was taking the minutes of the meeting and report the complaints and allegations to [the facility’s Activity Director] after the meeting.” As a result of that report, the activities staff member and the Activities Director “sent an email to [the facility’s Director of Nurses] on Friday, 06/05/2015 to inform her of the allegations made by [both resident’s].”

The investigator noted that the Director of Nursing “was asked about the allegations in the Resident Council Minutes on 06/05/2015.” The Director stated “receiving an email sent by [the Activities Director] on 06/05/2015, but did not open or read it until today 06/09/2015.” The Director was then “asked to review the facility’s investigation and the report sent to the Illinois Department of Public Health (IDPH).” In response, the Director of Nursing “stated an investigation often started and IDPH was not notified” in direct violation of state and federal nursing home regulations and laws.

  • Failure to Provide Residents Proper Services to Prevent Urinary Tract InfectionsIn a summary statement of deficiencies dated 06/12/2015, the state investigator noted the facility’s failure “to assess, evaluate and implement a Bowel and Bladder program for residents identified as incontinent of Bowel and Bladder.” The investigator also noted the facility’s failure “to implement the Bowel and Bladder policy and procedure and to develop and implement a Plan of Care in order to improve or maintain their bowel and bladder function.”An interview with the facility’s Director of Nursing, it was revealed that “the facility has no Bowel or Bladder program, this area (Bowel and Bladder) is very new to us. We assigned the Minimum Data Set/Care Plan Coordinator to run the program, but I am the enforcer […and stated that] the facility does not have a certified restorative nurse with the knowledge necessary to manage a Bowel and Bladder program, nor are there any plans to obtain one.”

Client Reviews

Jonathan Rosenfeld was professionally objective, timely, and knowledgeable. Also, his advice was extremely effective regarding my case. In addition, Jonathan was understanding and patient pertaining to any of my questions or concerns. I was very happy with the end result and I highly recommend Jonathan Rosenfeld.

- Michonne Proulx

Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own.

- Ethan Armstrong

Jonathan helped my family heal and get compensation after our child was suffered a life threatening injury at daycare. He was sympathetic and in constant contact with us letting us know all he knew every step of the way. We were so blessed to find Jonathan!

- Giulia

This lawyer really helped me get compensation for my motorcycle accident case. I know there is no way that I could have gotten anywhere near the amount that Mr. Rosenfeld was able to get to settle my case. Thank you.

- Daniel Kaim

Jonathan did a great job helping my family navigate through a lengthy lawsuit involving my grandmother's death in a nursing home. Through every step of the case, Jonathan kept my family informed of the progression of the case. Although our case eventually settled at a mediation, I really was impressed at how well prepared Jonathan was to take the case to trial.
