McHenry Nursing Home Resident Safety Concerns

- Failure to Provide Every Resident an Environment Free from Abuse/Involuntary Seclusion In a summary statement of deficiencies dated 05/02/2016, a notation was made during an annual licensure and certification survey by a state investigator concerning the facility’s failure to “keep a resident free from sexual abuse by [another resident at the facility].” The deficient practice by the nursing staff and Administrator at Alden Terrace of McHenry Rehab affected two residents.A review of the facility’s records revealed that at 8:50 AM on 05/02/2016, two residents “were each seated in wheelchairs in the 100-wing dining room eating breakfast.” One resident recalled that while sitting outside along the side of the building on the sidewalk the two residents were talking. That resident said “I looked over and he [the other resident] had his penis laying out of his shorts. He [the other resident] asked me, ‘Do you want to see my penis?’ I told him, ‘No’.” At that time, the first resident returned to the building and told the facility’s Activity Aide that they were upset.”On 05/02/2016 at 10:50 AM, a third resident related that “about six months ago or so, [the male resident] exposed himself to me. I don’t remember the date but I remember looking across the hallway and he was standing in the doorway of his room with his penis hanging out of his shorts […and] stated ‘Hey, look at this’.” The third resident indicated that they told someone about the incident but could not remember her name.
The state inspector interviewed the facility’s Licensed Professional Counseling that same day at 11:32 AM who stated, “Yes, [the third resident] told me about [the male resident] exposing himself to her. I think it was at least six months ago. She didn’t want me to say anything at the time to [the male resident] but I did notify the Social Worker that was here at the time. I don’t remember her name. She’s not here anymore.”
An interview was conducted earlier that day at 9:32 AM with the facility’s Director of Nursing who stated that the male resident “has a history of exposing himself. We try to continue to educate him on those behaviors. We just have to monitor him.” The investigator asked the Director how the facility monitors the male resident’s behaviors. The Director of Nursing replied, “We just try to monitor where he is at.” 18 minutes later, the investigator interviewed the facility posse’s Assistant Administrator who stated that the male resident “has a history of being promiscuous and [has] impulsive behavior. He has made inappropriate sexual comments that staff members before.”
The investigator noted that the actions and inaction of the Administrator and nursing staff at Alden Terrace of McHenry Rehab failed to follow procedures and protocols and the facility’s April 2016 Abuse Policy that reads in part:
“This facility affirms the right of our residents to be free from abuse. This facility therefore prohibits mistreatment, neglect or abuse of its residents.”
