An elderly man’s family took legal action after he passed away in an Illinois nursing center. He was eighty years old when he choked on food and died.

Before the incident, he suffered from diabetes and required a PEG and a special diet. The staff deviated from that prescribed course of care and gave him hard food through the mouth.

The resident could not consume solid foods and died from the mistake. His children filed a civil lawsuit in state court for the pain and loss of his death. They sought compensation from the facility and the medical professionals who rendered him care.
