Nursing Facility Resident Safety Concerns
Every year, the federal government updates all of its current star rating summaries on www.Medicare.gov showing the current evaluation of nursing homes, assisted living centers, healthcare facilities and rehabilitation homes nationwide. Currently, Capital Healthcare and Rehabilitation Center maintains an overall one out of five star rating. This includes two out of five stars for quality measures and one out of five stars for both staffing and health inspections, which is much below the national average.
Additionally, the Springfield nursing home neglect attorneys at Rosenfeld Injury Lawyers LLC have found very many complaints and investigations opened against Capital Healthcare and Rehabilitation Center. A small sample of these complaints include:
- Failure to Prevent the Spread of Infection throughout the Facility
In a summary statement of deficiencies dated 03/23/2015, a notation was made that the “facility must establish and maintain and Infection Control Program designed to provide a safe, sanitary and comfortable environment and to help prevent the development and transmission of disease and infection.” This is in response to a special focus survey noting the lack of an infection control program that prevents spread of infection. This includes designing protocol that prohibits “employees with a communicable disease or infected skin lesions from direct contact with residents or their food, if direct contact will transmit the disease.”
- Failure to Properly Investigate Allegations of Abuse
In a summary statement of deficiencies dated 01/08/2015, a complaint investigation was opened against the facility noting that it “failed to conduct a thorough investigation for an allegation of abuse [of a resident].” This is in response to a document noting that a resident “had bruising to both arms.” In addition, the resident stated “that eight staff members at the facility are not treating him well. [The resident] stated that staff are causing the bruises on his hands.” Documentation of the time indicated that “there is nothing in the investigation report that shows other residents or direct care staff were interviewed.”
- Failure to Provide a Residential Environment Free of Physical Restraints
In a summary statement of deficiencies dated 10/31/2014, a complaint investigation was opened indicating that the facility “failed to assess and document the risks versus benefits for use of restraints [on a resident].” This is in response to a resident being observed “to have a seatbelt like restraint across her lap on her wheelchair.” At the time of the report, there was no restraint assessment in [the resident’s] medical records regarding [the resident’s] seat belt, her inability to remove the seatbelt, and the risks versus benefits of using the seatbelt.”
