According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous episodes of poor patient care at Buckingham Pavilion which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to ensure accurate medication administration:  “Observation in emergency room substantiates R20 had at 2 least patches on at one time and for a 12 hours period of time received more medication then was ordered. The application of a second patch without removal of old patch is counter to written physician order [REDACTED].”
  • Failure to ensure staff follow infection control policy: “On 2/15/12, E3 (Registered Nurse) took R3 & R6 bedside blood sugars on 12:00 PM & 12:25 PM respectively. E3 disinfected the BGM with chlorine base solution after use for only 20 seconds wet contact time on both occasions. E3 stated on 2/15/12 at 12:30 PM, she was not sure how long the disinfectant solution should be on the equipment before letting it air dry. According to the manufacturer’s recommended instruction for the chlorine base solution, “Wipe surface with towel until completely wet. Let stand for one minute. To kill TB, let stand for two minutes at room temperature. Wipe dry or allow to air dry.”
  • Failure to provide incontinence care in a timely manner: “On 12/20/10 during initial tour of the 2nd floor with E4 (quality assurance) at approximately 10:50am R11 was observed in bed. Surveyor asked E4 to observe R11’s body. E4 removed the bed covers and turned R11 toward the wall. The underpad beneath R11’s bottom was saturated with urine that had partially dried and surrounded by a brown ring. R11 was wearing a blue adult diaper. This diaper was removed by E4 and surveyor observed a large amount of soft brown stool in this diaper. During interview, it was indicated that E5 started duty on this day at 7:00am. This interview and observation of R11’s underpad on this day indicated that it had been at least 3 hours and 50 minutes since R11 had incontinence care provided.”
