Concerning Findings Regarding Patient Care At Bronzeville Park Nursing & Living Center

A survey conducted by the Illinois department of health and other private health Inspection organizations (ProPublica), unearthed numerous episodes of poor patient care and laxity that could be labeled under the term of nursing home negligence. Our nursing home attorneys were contacted to review these findings and we came up with the following facts/conditions that highlighted the possibility of negligence on the part of Bronzeville Park Nursing & Living Center:

  • Failure to supervise and monitor residents to prevent falls:  “R13’s care plan with an onset date of 11/25/2009 documented R13 at fall risk due to falls on 3/12/09 slid to the floor from wheelchair in dayroom and 5/24/09 no injury. Interventions included but not limited to: -assist resident and or family in providing non-skid shoes.-5/27/09 alarm to be given and placed on wheelchair when up and on bed when in bed to alert staff upon resident rising. R13’s fall investigation and incident report of 12/07/2009 do not report of an alarm activated prior to R13’s fall in the day room. Also, on 12/10/2009 at 1:45pm, the surveyor met with R13 while positioned in a wheelchair in the 3rd floor dining room. R13 had a pair of regular white sock without any shoes. No alarm was visible at the time.”
  • Failure to give treatment to prevent the development of bedsores: “R1 is totally dependent on staff for all activities of daily living. Facility weekly skin surveillance report for 9/24/09-9/29/09 denotes a [MEDICAL CONDITION] wound was found to R1’s heel on 9/20/09. Wound care notes denote the partially opened blister measured 0.5 cm length x 0.6 cm width- with light amount of drainage noted. R1 was observed on 10/06/09 in the dining room in a reclining chair with both feet dependent on foot rest. E10 was informed of the observation and stated foot should be off-loaded. E10 proceeded to apply heel protectors to both feet. R1 was again observed on 10/7/09 in bed with no heel protectors in place. E10 was informed again of observation. No heel protectors were observed in R1’s room or cabinet drawers.”
  • Failure to provide social services to assess and develop necessary interventions for patients with anxiety: “On 10/20/11 at 3:45 PM, R14 stated he was anxious about taking a shower due to possibility that his dialysis port site could get infected if not covered. R14 stated his doctor told him this because if infected this could cause a serious heart infection or worse. R14 stated that the nurses don’t listen to him they just tell him he needs to take a shower and don’t provide him with the things he needs to keep from getting infected. On 10/20/11 at 4:00 PM, E36( Social Services Director Assistant) stated she did not know R14 had anxiety about care of dialysis access catheter getting infected and that he did not want to shower because of this reason. E7 stated resident has not showered in weeks. E7 reports R14 needed a psychiatric evaluation about his anxious behavior and she will make a psychiatric referral for him. ”
  • Failure to ensure residents are free from serious medication errors: “The facility failed to give R16, who suffers from osteo[DIAGNOSIS REDACTED] pain, a daily topical pain medication for 4 days. As a result, this resident experienced intolerable pain before and during a [MEDICAL TREATMENT] treatment. The surveyor asked R16 if she was in pain. R16 replied, Yes. The surveyor asked R16, on scale 1 to 10 with 10 being the worst, what is your pain. R16 stated, 12. R16 became agitated, rising her voice. R16 apologized to the surveyor and stated she was just in so much pain.”
