Concerning Findings Regarding Patient Care At Bridgeview Health Care Center

According to data from nursing home surveys conducted by the Illinois Department of Health and other agencies, there have been numerous episodes of poor patient care at Bridgeview Health Care Center which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:

  • Failure to keep residents free from restraints unless necessary for medical treatment: “Observation of R1 for 3 of 3 survey days (3/6/12 to 3/8/12) showed R1 sitting in his wheelchair with a tray table at all times. R1’s tray was released only after lunch time to lay him down in his bed. Restraint care plan dated 12/6/11 indicated to release device every 2 hours for care, exercise and repositioning.”
  • Failure to implement the facility’s Abuse Prevention Policy: “During the initial tour of the facility with E3 (Director of Nursing) on 3/6/12 at approximately 9:45am, R5 was in bed, lying on her left side with eyes closed, apparently asleep. Z5 (family member) was at the bed side. Z5 stated that she visits with R5 once weekly and R5 has not been eating for the past one week. Z5 went on to say that she received a call from the facility five days ago and was notified that R5 had a fractured left foot. Z5 stated that the cause of the fracture is unknown. Z5 stated that R5 has recently developed bad bruises on her arms and her upper body is full of bruises. Z5 stated she believed the bruises are a result of staff handling R5. Incident Report dated 9/18/11 states R9 was noted with discoloration (dark red/purplish) and swelling to left elbow. Nursing notes dated 9/18/11, 11:22pm, states X-Ray results shows [MEDICAL CONDITION]. There was no evidence that an investigation was conducted to investigate the source of R9’s injury. E1 informed survey team on 3/9/12 at approximately 10:30am that the incident was not reported to the State Agency. Review of facility’s Incident Report Log and Accident/Incident/Unusual Occurrence Report dated 10/11 through 3/4/12 reveals missing or incomplete investigations for the following incidents on unknown origin: R29(12/26/11) and R39 (2/6/12) were noted with swollen extremities; R27 (1/11/12), R37 (1/17/12; 1/21/12), R40 (12/31/11), R41 (2/26/12), R43 (10/29/11) sustained skin tears/scratches; R32 (1/27/12), R35 (1/12/12), R36 (12/29/11), R38 (1/3/12), R40 (2/28/12), R44 (10/27/11), R45 (12/16/11), R46 (12/24/11) were noted with bruises.”
  • Failure to conduct employment reference checks for newly hired employees: “During review of personnel files for newly hired employees with E2 (Assistant Administrator) on 3/8/12 at approximately 3:15pm, E2 stated that the employee responsible for conducting pre-employment reference check for new employees would not be available through the conclusion of the survey. E2 went on to state that it is the facility’s policy to obtain 2 reference checks, one written and one telephone reference, prior to employment. E16 is a licensed practical nurse (LPN) began employment on 12/6/11. There was one phone reference on file which does not address E16’s performance history. E2 stated that the previous employer elected to verify dates of employment only. E16 listed 3 previous employers but facility failed to obtain additional employment verification. E27 (LPN) began employment on 2/6/12. There were no previous employment verification found in the personnel file.”
  • Failure to keep the rate of medication errors below 5%: “On 3/7/12, at 8:25am, E21 (Nurse) administered [MEDICATION NAME] 10mg by mouth to R29. March, 2012, POS lists an order to hold [MEDICATION NAME] if the systolic blood pressure is below 120. March, 2012, Medication Record documents R29’s morning systolic blood pressure as 118. On 3/7/12, at 8:40am, E11 (Nurse) administered [MEDICATION NAME] 500mg 2 tablets by mouth to R30. March,
    2012, POS lists an order for [MEDICATION ORDERS REDACTED]. E11 punctured the capsule in the hand held device. R30 quickly inhaled once and exhaled immediately, not holding his breath. When R30 was asked if he could hold his breath, R30 replied “yes” . Facility policy titled Medication Administration states that for oral inhalations the nurse should ask the resident to exhale completely, breathe in deeply and slowly through the mouth, and hold breath as long as it is comfortable before exhaling.”
