- Failure to develop policies that prevent mistreatment, abuse, or neglect of residents: “This failure resulted in 18 of 18 employees hired since the last annual survey not having a reference check, E12, E13, E14, E15, E16, E17, E18, E19, E20, E21, E22, E23, E24, E25, E26, E27, E28 and E29. Based upon an interview on 8/5/10 conducted with E3 (administrator) and E30 (human relations director) who stated, “we do not document when we conduct a reference check, we just call the previous employer. We do not send out any forms we just call.”
- Failure to take measures to prevent the development of pressure sores: “R1 was seated in a wheelchair, and was returned to bed. E2 and E9 (CNA) returned R1 to bed and observed pressure sore area not covered with a dressing, revealing two pressure sores; a redden area with sero-sanguinous drainage. After prompting, E8 (charge nurse) was instructed by E2 to measure wounds; assess and call physician. E8 provided the following assessment: Sacral wound reddened surrounding areas 6cm by 10 cm denuded skin; center area of wound 4cm by 6 cm-center, 40% wound bed eschar; surrounded scattered slough. The certified nurse aide E9 interviewed and stated, “I got R1 up between 7:30 am and 8:30am put in chair, there was a bloody balled-up gauze and I threw it away. I did not tell the nurse.”
- Failure to ensure residents are safe from serious medication errors “During the medication pass conducted on 8/4/10 at 10:00am, R15 was observed seated in a chair in the room with her head bowed down and in response to E1 (charge nurse) stated, “I do not have my inhaler. I have not had it for one week. This one is out (handing inhaler to E1) I told the nurses, they said okay and I need it. I was short of breath for two days.” E1 stated, “yes it is out, (shaking inhaler and handing to surveyor). E1 stated, “I pulled labels and sent it to the pharmacy for refills, (checking cart for meds) I do not know where it is, it is not in cart.” E1 checked R15’s room drawers and was unable to locate inhaler.”
- Failure to provide adequate supervision and assistance to prevent falls: “Between April 17, 2010 and July 19, 2010, R2 had a total of six unwitnessed falls. The Fall Risk Assessment (initial and quarterly) only indicates to proceed to care plan. At 1:15pm E2 and E4 did not present any documentation to indicate an assessment was done after each fall incident or that the careplan was updated after each fall incident.”
