Incredulous Discoveries Regarding Patient Care at Bethany Terrace Nursing Centre
According to data from nursing home surveys conducted by the Illinois Department of Health other agencies, there have been numerous series of poor patient care, staff negligence and mental abuse at Bethany Terrace Nursing Centre which can be construed as nursing home negligence. Our nursing home attorneys reviewed data compiled by ProPublica and found the following conditions that can be construed as nursing home negligence:
- Failure to investigate and report allegations of abuse: “The facility’s concern log had an allegation of abused dated 8/18/2011 involving R16. There was no documented evidence Public Health being informed of this allegation of abuse.
On 12/30/2011 R18 made an abuse allegation. E23 (nurse aide) was accused of physical and mental abuse by R18. The facility informed Public Health via fax on 12/30/2011 and a final report on 01/06/2012. The investigation reported and supporting documentation did not indicate if or when E23 was suspended. On 4/25/2012 at 4:30pm, the survey team requested any supporting evidence of how R18 was protected during the investigation. On 4/26/2012 E1 (administrator) offered no additional evidence for review.”
- Failure to make call lights accessible to residents: “On 4/2/12 at 9:50am during tour R29’s call light was not within reach, it was on top of the bed. R29 stated, “Sometimes it is too far to reach.” R22’s call light was not within reach, it was tangled between the wall and the night stand. R23’s call light was not within reach for the resident, it was behind the bedside table. R24’s call light was not within reach, it was by the wall, behind the resident. On April 23, 2012 at 10:35 am during the initial tour, R10’s call light was wrapped around the rail and hanging on the rail. R10 was trying to reach it but it was not accessible.”
- Failure to protect residents from serious medication errors: “R11 was admitted to the facility on [DATE] with the [DIAGNOSES REDACTED].R. tablets, take one tablet oral every 12 hours for 30 days 12:00am & 12:00pm. On 4/24/12 at 2:20pm (location-resident room) R11 stated that the nurses do not provide R11’s pain medication on time. R11 stated that R11 asks for medication prior to physical therapy and often does not receive it. R11 stated that R11 went to physical therapy on this date shortly before 1:00pm and completed therapy prior to 2:00pm. On 2/24/12 at 2:25pm, E12 (RN) entered R11’s room and administered [MEDICATION NAME] sulfate 15mg. E12 stated the schedule time for the [MEDICATION NAME] sulfate was 12:00pm. E12 stated the facility’s policy for administering medication is 1 hour prior to 1 hour after scheduled medication time. However, E12 administered the [MEDICATION NAME] sulfate 2 1/2 hours after the scheduled medication time.”
- Failure to provide timely care: “Based on interview and record review, the facility failed to send resident to the hospital in a timely manner; it took 18 hours and 45 minutes to send resident to hospital and received treatment, and no
documentation of effective pain management, after resident fell and sustained a hip fracture. On 6/23/11 at 7:55 PM, R3 was found lying on her back by the bedroom door. R3 stated she was looking for the beauty shop and she tripped. The facility paged the doctor several times, receiving no reply. 6//24/11 at 2:40 PM, R3 was transferred to hospital ER via ambulance. On 6/24/11 at 6:35 PM, facility was informed; R3 was admitted at the hospital for fracture of left hip. On 12/6/11 Z1 stated that the facility could have called him on his cell phone, Z1 was not sure why facility couldn’t get in touch with him at that time. Facility could have transfer R3 out without his order; they could have notified the medical director and sent R3 out if it was urgent. Z1 remembered talking to facility (on 6/24/11) after they paged him, he was informed that R3 couldn’t stand or walk. Z1 added, if there’s a [MEDICAL CONDITION], there would be limitation of movement, a person would not be able to stand or move, and would be in a lot of pain.”
